EZAM IS BEING CHALLENGED TO STAND IN BY ELECTION
Ezam Mohd Noor has to decide whether to stand against DSAI. So do UMNO and BN. Let rakyat see and decide for themselves despite the odds facing DSAI.
From The Staronline
Last week, Ezam, who has joined Umno, said that he was willing to take on Anwar in a by-election and was not afraid to face his former boss if selected by the Barisan Nasional leadership.
Khalid, who is Selangor Mentri Besar, said the party congratulated and thanked PKR president Datuk Seri Dr Wan Azizah Ismail for stepping down as Permatang Pauh MP to make way for her husband to contest in the by-election.
When asked if Anwar’s decision to stand in Permatang Pauh was expected, Khalid replied: “Sort of, but Bandar Tun Razak and Kulim were always mentioned.”
Khalid also said he was starting the campaign immediately by calling the rakyat to choose a leader who would work hard to reduce their burden, especially in the face of inflation.
On PAS rejecting the possibility of it cooperating or forming a coalition government with Umno, Khalid said it was expected.
He said he had no problems with PAS if it wanted to hold talks with Umno because he believed PAS would advise him on how to run the state and ensure that Muslims and other communities were treated fairly.
FOOD FOR THOUGHT: IS THIS THE RIGHT WAY TO HONOUR OUR WARRIORS?
To the man on the street or ordinary citizen, there is nothing wrong to celebrate the warriors day as it had been celebrated all these years. To an ordinary person, the statue of Liberty in the USA is no more than a crafted stone to commemorate their history. To a thinking person, what benefits would one derive by saluting "bronze" or "stone" statute. A non-thinking, yes-man, blind follower and non active person is akin to a "statute" , "boneka" ," puppet" or "patung".
There must be a better way to honour and remember the sacrifices made by our heroes and warriors.
BE- END COOPERATION NO. OK.
It is now finalised and agreed upon by the members of the Central Working Committee (Jawatankuasa Kerja PAS pusat) as well as Ulama' Consultative Council (Majlis Syura Ulama') that any cooperation to form a government either in the form of a merger or power sharing with UMNO/BN is out of the question for now. Period.

PAS rejects ties with BN or Umno

KUALA LUMPUR(July 31, 2008) : PAS decided today against any cooperation with the Barisan Nasional or Umno to form a government, either at the state or federal level, be it in the form of power-sharing or merger.
Speaking to reporters at the party headquarters after chairing a joint-meeting of the party’s Central Committee and Ulama Syura (Consultative) Council, party president Datuk Seri Abdul Hadi Awang said with this decision, "any offer from Umno to set up a joint-government at all levels does not arise".
He said the party will however continue to have talks or discussions with anyone, including political parties, non-governmental organisations, institutions and individuals in the interest of the country and ummah.
Abdul Hadi also reiterated PAS’ stand to remain in Pakatan Rakyat, a coalition of opposition parties that helms five state governments.
"I would like to reiterate our stand to remain in Pakatan by playing an active and positive role in line with our collective struggle, including our fight to change the government. In this context, we would like to invite Umno MPs to join Pakatan, either (through) PAS or PKR, so that we can support this struggle together."
He said the decisions reached during the five-hour meeting yesterday have always been the party’s stand all this while and were further reinforced during the discussions.
He said the question of "secret meetings" between PAS and Umno leaders does not arise as it is no longer confidential.
"There is nothing confidential now. We have said that we can meet and of course, the meetings would be made known to the party. And all these while too, they (previous PAS-Umno talks) have always been made known to the party," he added.
As to whether the meetings will be called muqabalah (face-to-face meeting) or muzakarah (discussion), he said: "I have used the word pertemuan (meeting) in general, it does not matter what term is used."
Asked when PAS will make its offer to the Umno parliamentarians, he said: "That you have to wait when the time comes."
To a question, Abdul Hadi said the party appreciates the support from non-Muslims, especially during the last general election, and in future, it plans to give a more substantial role for non-Muslim supporters to play within the political realm.
Asked his stand in relation to Datuk Seri Anwar Ibrahim's sodomy allegation case, he said he had stated before that PAS as an Islamic party wants the issue to be settled through the Islamic Syariah method.
"I refer to Article 121(a)(1) of the Federal Constitution that all cases related to a Muslim must be referred to the Syariah court. If this cannot be done, Umno must make the necessary changes. I don’t want for this issue to be politicised," he added.
Asked whether he supports Anwar, he said: "I defend whoever is being victimised (dizalimi>) including Anwar, and according to the Islamic law, a person who is accused is not guilty (until proven guilty)."
Non starter for PAS-Umno merger

THEY should not have bothered. That seemed to be the view of a number of dyed-in-the-wool PAS members on recent talk about the possibility of their party and Umno sharing power or even merging.
They were right and are breathing easy again now that all talk of merger or even power sharing, like many times in the past, is aborted. They agree, of course, that whether muzakarah or muqabalah this is hardly going to be the last word said on the subject.
Some of them say that if their views were sought by their party officials at the early stages of the talk they would tell them straight in the face that merger is a dead horse.
Because it drew a lot of public attention for a couple of months and involved top officials of the party, the talk is likely to be raised at the PAS general assembly beginning Aug 13.
Some people are going to be mauled. And it is to mitigate what may turn out to be an unprecedented ugly muktamar is one of the reason the special Pas central working committee was called yesterday mostly to evaluate the talk that was beginning to focus more on power sharing and merger.
PAS members say they are generally grouped under those who are die-hard or dyed-in-the-wool members, who constitute the majority, those who can work with other parties but not Umno, and those who may tolerate working with Umno over the question of Malay unity.
According to die-hard Pas members their party is gradully gaining greater acceptance among the Malays as reflected in the number of parliamentary seats the party won in 1999 and on March 8 and believe they will win more in the next general election. So why bother?
They believe that Pas, as told to them by their leaders, was cheated in 2004 but they are confident the party will one day rule Malaysia either singly or at the head of a coalition dominated by their party. For them it is better for Umno and Pas to remain separate.
"For the moment there is no real danger of the Malays losing political power," said Pas secretary general Datuk Kamaruddin Jaafar who do not see any real need for the two parties to merge or even share power.
Among the argument against the continuation of the talk on power sharing or merger raised at the fiery meeting yesterday was the opposition of the voters, both Malays and non-Malays, who had voted for Pas candidates for the first time .
Among those who tried to discourage the talk from zeroing on on power sharing and even merger was none other than the party spiritual leader Datuk Nik Aziz Nik Mat. The wily Kelantan Pas icon who is known for his distaste for working with Umno suggested some outrageous terms before the two parties could merge.
One was that the merged party should champion the cause of implementing Hudud punishments and Qisas laws in the country which effectively means the new party should work towards turning Malaysia into a theological Islamic state.
It may have appealed to Pas members but it was a sure way of killing the idea among Umno members. While there were those schmaltz who screamed "Malay unity is good for national unity" there are also many Umno stalwarts who feel that Barisan Nasional is still a good idea.
Some PAS officials admit that it was the declaration by PKR de facto leader Datuk Seri Anwar Ibrahim that it was possible to topple the BN federal government with the help of crossovers from Sabah and Sarawak that triggered the two parties to woo each other.
For the BN and Umno leaders it is obvious. Should Anwar manage to entice 31 of the 54 BN MPs from the two East Malaysia states to join the loose Pakatan Rakyat opposition coalition of 81 Dewan Rakyat members (PKR 31, DAP 28 and PAS 23), it will mark the end of the rule of a coalition which had ruled the country since Merdeka. To stay in power it must deny Anwar the numbers.
Less obvious is PAS reason for wanting to talk to Umno. For the party which wants to remain true to its ideology and long term objective for turning Malaysia into a theological Islamic state, some of its leaders do not relish the thought of being a junior partner with secularists in a national ruling coalition.
They do not want it to be political capital for its enemies, especially Umno --- if it still remain a formidable force should the BN government falls --- in the next general election.
To people like deputy president Nasharuddin Mat Isa talking with Umno may offer alternatives that may be more acceptable. Thus, he was at the forefront of the Umno-Pas dialogue billed as Malay unity talk.
But it is clear now, even before the muktamar which is about a fortnight away, that the core members of the party are against sharing power or merging with Umno. The two parties can, of course, continue to talk to each other. But for Umno, what is there to talk about?

BENARKAH ANWAR AKAN DITAHAN
Anwar dijangka cuba ditahan dalam tempoh 48 jam
Harakahdaily

AP PERMATANG PAUH KOSONGKAN KERUSI BERI LALUAN SUAMI
Teki teki akhirnya terjawab. Bukan kerusi Bandar Tn Razak atau Kulim tetapi Permatang Pauh yang DSAI akan bertanding Insya ALlah. Semoga dimakbulkan segala cita-cita.
Keputusan terbaik untuk negara:Wan Azizah

Thu | Jul 31 08

Pembinaan empangan hidroeletrik mempunyai masalahnya tersendiri walaupun kuasa eletrik
Projek Empangan hidroelektrik Sarawak disokong
Serangan siput gondang emas semakin buruk
ANTI CORRUPTION AGENCY IS BUSY
With the current hives of activity amongst ACA personnel, to ask for more allocation and manpower from JPA is a reasonable thing to do. There is no news about the promised changes and process reengineering in the ACA mentioned by YAB PM.
In another development, IGP claimed that allegations about malpractice in the Logistic Dept started when the Police uncovered attempts to cheat the Dept by unscrupulous suppliers.
ACA probes police procurement malpractice involving millions of ringgit

PUTRAJAYA (July 30, 2008) : The Anti-Corruption Agency (ACA) has started investigations into allegations of malpractice in the police procurement involving about RM198 million, involving the purchase of dogs, equipment, vehicles and uniforms.
ACA deputy director-general Datuk Abu Kassim Mohamed said agency officers had been sent to the Bukit Aman federal police headquarters to look for documents to determine whether there were elements of corruption in the police procurement.
"We will get all the related documents first, then we will discuss it and study the evidence. We will look at the implications, whether there were possible offences related to procedures, non-compliance of the laws or criminal offences like making false claims or others," he told reporters who asked whether any arrests were expected soon.
"We will look at it. If there is a strong case, we will carry on with the investigations," Abu Kassim said in the ACA headquarters here today after a meeting with Malaysian Crime Prevention Foundation (MCPF) executive council member Tan Sri Robert Phang.
Phang today submitted an eight-page document to the ACA involving an allegation of malpractice in a RM98 million procurement for the police force involving six high-ranking officers.
Inspector-General of Police Tan Sri Musa Hassan was meanwhile reported to have also started an internal probe into malpractice in the police logistics department involving more than RM100 million, and that at least 12 officers and men, including an Assistant Commissioner of Police, have been transferred.`
Yesterday, Phang disclosed he had received documents on July 23 from an unidentified whistleblower alleging that the federal police logistics department failed to comply with standard operating procedures (SOP) when conducting procurement during the 12th general election.
Phang said the documents implicated six officers, including a "very senior police officer".
On Phang’s documents, Abu Kassim said the ACA will act if there were elements and evidence "for us to do so".
"We take this matter seriously. There are some information which we can get clarification from the parties (identified in the documents)," he added.
He said the ACA had been communicating with the police on the matter on several occasions before, and the police had also submitted several reports to the agency.
"The IGP has also contacted us to look at cases related to administration and logistics. So, the police do refer to ACA if they need to do so. And, there are certain things related to this which we are investigating now," he added.
When contacted, Phang said the documents that he handed over to Abu Kassim contained some new information that implicated at least six officers.
"I believe the ACA have gone to Bukit Aman at 8am today and seized some documents which were different from what I received. The documents have complemented what the ACA needed because more culprits were identified," he added.
Police investigating RM100mil logistics fraud bid
By LOURDES CHARLES
Staronline
KUALA LUMPUR: The federal police logistics department has uncovered attempts by unscrupulous suppliers to cheat it in the supply of equipment worth more than RM100mil.
It is learnt that Inspector-General of Police Tan Sri Musa Hassan has set up a committee to investigate, and ordered the immediate transfer of at least 12 officers and men, including an Assistant Commissioner of Police.
Also transferred and under investigation are several civilian staff in the finance department.
“We have reported the matter to the Anti-Corruption Agency (ACA) and ACA officers have met our officers, questioned them, and taken away several documents,” he added.
“We have started an internal investigation as we believe we can save the Government hundreds of millions of ringgit by preventing suppliers from providing us with sub-standard products.”
Musa said he believed certain quarters with vested interest had been accepting the goods ordered without conducting proper pre-delivery checks.
The IGP said the committee in the logistics department headed by its director, Commissioner Datuk Mahsuri Zainal, had been scrutinising every single order and found several discrepancies.
Among the equipment or goods rejected recently were boots for the elite SWAT unit, machetes (parangs) for the General Operations Force, evacuation packs for officers and men serving in Timor Leste, beds, road-block signages and cones.
“As a result of the stringent checks, many started writing and hurling allegations and accusations against the members of the committee,” Musa added.
“They are not happy with the stringent procedures now in place as they were used to having it their way, with no questions asked.”
In a related incident, a whistle-blower has alleged that six high-ranking officers from the logistics department had committed malpractices when making purchases worth RM98mil earlier this year.
The whistle-blower detailed at least six instances during the pre-election and election season where the officers were said to have bypassed standard operating procedure when making purchases.
The person made the allegation in a letter to Malaysia Crime Prevention Foundation executive council member Tan Sri Robert Phang on July 23.
In the same envelope, the whistle-blower included four copies of the same letter. The person requested Phang to make sure the letters reached Home Minister Datuk Seri Syed Hamid Albar, Internal Security Ministry secretary-general Tan Sri Abdul Aziz Mohd Yusof, Inspector-General of Police Tan Sri Musa Hassan and Anti-Corruption Agency director-general Datuk Seri Ahmad Said Hamdan. Khalil Yaakob 'juara' bida nombor plat kereta negara
Zaili Muhammad
harakahdaily

MCPF reveals RM98 million alleged police malpractice

KUALA LUMPUR (July 29, 2008) : The Malaysian Crime Prevention Foundation (MCPF) today revealed an allegation of malpractice in a RM98 million procurement for the police force involving six high-ranking officers.
MCPF executive council member Tan Sri Robert Phang said he received letters which are a compilation of the malpractice on July 23 and the sender, whom he declined to disclose, had requested him to hand over the letters to Home Minister Datuk Seri Syed Hamid Albar, Home Ministry secretary-general Tan Sri Abdul Aziz Mohd Yusof and Inspector-General of Police (IGP) Tan Sri Musa Hassan.
"The whistleblower alleged that the logistic department of the police force had failed to comply with the standard operating procedure (SOP) when conducting procurement including the buying of dogs during the general election (in March).
"Allegations have also named six high-ranking officers ranging from ASP (Assistant Superintendent of Police) to CP (Commissioner of Police)," he told a press conference with former founding president of Transparency International Malaysia Tunku Abdul Aziz Ibrahim.
Phang said he had also consulted the Anti-Corruption Agency (ACA) and was told to hand over the documents to the agency for investigation.
"If one government agency does not follow the SOP, it will lead to malpractice and corruption.
Phang said in view of the recent crackdown on the Immigration scandal and the government's commitment to prevent and fight malpractice as well as corruption, he had discussed the matter with Institute of Integrity Management director-general Datuk Dr Mohd Tap Salleh and Tunku Abdul Aziz.
"We decided that (the best way to uphold) transparency, is to call a press conference to tell the public about it."
"I want to assure the whistleblower, who sent the letters to me, that I will not only hand over the letters to the ACA but also ensure that the letters reach the recipients he named, and I will also make a copy of the letters to Chief Secretary to the Government Tan Sri Mohd Sidek Hassan," he said.
Phang also said he hoped that IGP, who is a no-nonsense man, will not act with double standards upon receiving the letters.
Abdul Aziz said the intention to call for the press conference was not to point fingers at the police but was an effort by the non-governmental organisation to help the police in fighting corruption.
"The whistleblower had chosen not to go directly to the authorities, probably because he does not trust the agencies to do what he considered to be the right thing, which is investigation.
"The whistleblower must have thought Phang has earned enough credibility,... that he will ensure the matters be brought to the attention of the authorities," he added. Read More “PHANG ANOTHER BRAVE CITIZEN” »»
DR MOHAMAD OSMAN MEMANG BERANI
Anwar urged the government to make it a "national priority" to ensure the safety of Dr Mohamed Osman Abdul Hamid, who allegedly signed the medical report, and his family following the leak of the medical report.
Mohamed had allegedly conducted a medical examination on the request of Saiful who complained that he was sodomised with a plastic object by a "very important person".
"Reports that he (the doctor) and his family may be in danger must not be taken lightly, given instances of key witnesses in high profile cases in Malaysia having been threatened, coerced or gone missing," said Anwar who praised the courage of those responsible for leaking the report, and called for more to step up and contribute their evidence.Siapa Dr. Mohamed Osman?

Suhakam: Give the toothless tiger teeth to bite

KUALA LUMPUR (July 29, 2008) : Faced with the threat of being downgraded by an international body, Malaysia's Human Rights Commission (suhakam) today asked the government for "teeth" so that the "toothless tiger" can bite.
Its commissioner Datuk Siva Subramaniam said they are not surprised that the threat has been made by the world body as even cabinet ministers have called them a "toothless tiger".
"Provide the teeth, then Suhakam can ensure that human rights are protected," he said, when approached by reporters at the 13th Annual Meeting of the Asia Pacific Forum of the National Human Rights Institutions today.
"Because you (the government) do not have trust in Suhakam. You yourself have said something that shows that Suhakam is weak," Siva said.
Asked about the threat of downgrading by the International Coordinating Committee of National Human Rights Institutions (ICC) if nothing is done within a year, Siva said: "The downgrading (threat) is because of government's regulations."
He said the Human Rights Commission Act 1999, under which Suhakam was formed, has limitations and needs to be amended. One of the limitations is that the commissioner's tenure of service is just two years while in many other countries it is five years.
He said many people feel that if the commissioner "speaks his mind out, there he goes".
Siva said Suhakam has done an excellent job in the past nine years and still believes it is on the right track.
"But Suhakam does not have enforcement powers. We make many discoveries during our visits (Suhakam's monitoring activities) but our suggestions are mostly recommendations and sometimes these recommendations are treated as nothing," he said.
He said in some countries, the Human Rights Commission has its own court and implements its powers and can give its own directives.
"It will be useless if we just make recommendations and they are not implemented," he said.
Siva said many wants a broader selection of commissioners culled from NGOs, civil societies and people who have a broader concept and understanding of human rights.
"Of course, some of these arguments are valid. The ball is at the government's feet. Suhakam had provided the advice (on providing the enforcement power) to the government," he said.
Suhakam had proposed this to the government in several meetings but there has not been any positive response.
On Suhakam's role, Siva said besides protecting human rights, Suhakam also meets the public regularly under its 'Meet the People' programme nationwide.
Suhakam had also visited local schools to promote human rights and their next visits would be to the prisons.
Siva said given that Suhakam is doing its best under the circumstances, it is inappropriate for ICC to demote it from Grade A to B, which means it loses its member right to participate in the United Nations Human Rights Council sessions.
HARGA BAHAN API MALAYSIA BELUM TURUN
Harga minyak dunia turun, kerajaan didesak tunaikan janji - Dr Hatta
Intan Abdullah
Harakahdaily
KETUA PENERANGAN PAS MOHON MAAF
Ditujukan Khas Kepada Ahli PAS, Para Penyokong serta Pengundi PAS
Permohonan maaf Ketua Penerangan PAS berhubung isu muzakarah
Harakahdaily
Mon | Jul 28, 08 | 7:18:21 pm MYT
Maafkanlah saya.
Sekian, wassalam.
Yang benar,
HAJI MAHFUZ HAJI OMAR
Ketua Penerangan PAS Pusat
Ahli Parlimen Pokok Sena

Guan Eng wants Yakcop to prove ‘attacks’ on economy
by Opalyn Mok
sun2surf
GEORGE TOWN (July 28, 2008) : Second Finance Minister Tan Sri Nor Mohamed Yakcop must clarify his statement and state who has been "attacking’" Malaysia’s economy, what methods were used and what can be done to avoid it, said Chief Minister Lim Guan Eng.
Expressing shock over Nor Mohamed’s statement on Saturday alleging that the country’s economy faces "attacks" every 10 years either coincidentally or by "unseen hands", Lim said this was a very serious allegation.
"Penang government will fully support any move by the federal government to counter these alleged ‘attacks’," he said at the Little Penang street market here on Sunday.
He said Nor Mohamed must ensure his assertions are backed by facts, as such allegations could adversely affect foreign investors’ confidence in the country. Therefore, Nor Mohamed must show proof of such ‘attacks’, he said.
"We want to know who is ‘attacking’ us and what measures they are using to ‘attack’ us," he said.
He also wants the federal government to reveal the measures it could take to counter and face these alleged threats.
"This is a very serious matter because it impacts the economy of the country and livelihood of Malaysians," he said.
On a separate matter, Lim said the state government has applied for RM13 million from the federal government to start its heritage conservation programmes for George Town which, together with Malacca, has been inscribed as one of Unesco’s World Heritage Sites.
He said the state government also plans to ask for a RM200 million soft loan from the federal government to undergo a full-scale heritage conservation programme.
"We need to repair and renovate all the old, dilapidated heritage buildings within the heritage zone in George Town," he said.
Lim also commented on Pas spiritual adviser Datuk Nik Abdul Aziz Nik Mat’s suggestion that Umno and Pas be dissolved and a new party based on Islam be formed to unite all Malays.
"We should be heading towards a more united Malaysia with political parties taking the lead by example to remain open to all Malaysians regardless of race, religion or sex," he said.
Although he did not directly criticise Nik Aziz’s suggestion, Lim said a party that puts a limit to it by way of race or any other factor would not be heading towards the vision of uniting the people.
"We are a multi-cultural society, so we should be getting rid of boundaries. We should lean towards the national aspirations of a united society and try to be all-inclusive instead of being exclusive," he said.
He said a political party should be open to all Malaysians to enable everyone to stand proud as a nation.
ALTANTUYA'S MURDER TRIAL: TO IMPEACH OR NOT TO IMPEACH
"Contradictory statements made but admitted that statements based on long term memory is correct and statements based on short term memory is false"-DSP Yusri of UTK ( Special Action Force)
Witness' credibility should not be impeached, says defence

SHAH ALAM (July 28, 2008): The credibility of trial-within-a-trial defence witness DSP Yusri Hasan Basri should not be impeached due to the time frame between the time of the incident, the time his statement was recorded, and when he testified in court, the Altantuya murder trial was told today.
Defence counsel for second accused Cpl Sirul Azhar Umar, Hasnal Redzua Merican said instead of impeaching Yusri's credibility, his testimony should be viewed together with the credibility of contradictory statements made by the prosecution's own witnesses.
Submitting during impeachment proceedings against Yusri, Hasnal said there were various contradictory statement made in court by the witnesses in relation to Yusri's credibility in response to the events of Nov 7, 2006 -- which has to be assessed by the court.
Yusri’s statement on his function to collect Special Action Unit (UTK) belongings during investigations at Sirul Azhar’s apartment on Nov 7, 2006 was only recorded on Aug 2, 2007.
Following this he was called to testify in court during a trial-within-a-trial pertaining the sequence of events on Sept 4, 2007.
There were several contradictions between the Yusri’s statement to the police and the ones that he made in court.
Yusri a UTK officer has since said his statement in court was the accurate one as he had thought about this over the month after giving his statement to the police.
Yusri stressed that his role that day was a small one – which was to collect items belonging to the UTK and so he did not heed the sequence of events.
Hasnal submitted on the points of the four contradictory statements as follows:
Contradiction 1
Razak baginda at the Shah Alam High Court today.
In his police statement: He said he was not sure if Sirul was brought to his room as he (Yusri) was looking for UTK gear.
In court: Yusri said the whole time he was in Sirul’s apartment, he was sure Sirul was not brought into his room.
Hasnal’s submission: Questions posed to the witness during the recording of the witness statement and also the questions put to him in court is much wider than the function he performed on Nov 7, 2006.
The witness said he had one month to think about his witness statement (taken 10 months after the incident) and that his testimony in court was the actual account. The prosecution is actually comparing his statement in court to the witness statement much earlier which was equally exposed to a tendency of forgetfulness, in accuracies and mistakes.
The context of the question needs to be looked at because his response was that he did not see Sirul being brought into the room, but what he was not sure of was whether this question was in relation to the time when he was in the room searching for the UTK items.
Contradiction No 2
In his police statement: He said when the D9 officers searched the room, he was not sure if Sirul was in there.
In court: Yusri said when he Sgt Rosli had gone into the room to collect the UTK items, D9 officers were conducting a search in the room, but Sirul was not in the room.
Hasnal’s submission: There is a world of difference to a witness committing himself to one answer and changing it on another occasion, than a witness who is not sure. This witness had one month to recall his memory and commit himself to an answer. It was not very clear from the questions out in court on who was doing the checks. With regards to the alleged contradiction; factually the witness testified on two different occasions altogether. So these cannot be said to be contradicting one another.
Sirul Azhar and Azilah at the Shah Alam High Court
today.
Contradiction No 3
In his police statement: He said he only entered the apartment after the D9 officers.
In court: Yusri said he entered Sirul’s apartment together with Zulkarnain and the rest of the D9 officers.
Hasnal’s submission: The order of who went into Sirul’s apartment first was not a consideration when Yusri had gone to the apartment to collect the items. It was not a matter of utmost concern to him. The time frame within which he was required to remember had long past – almost 10 months.
Contradiction No 4
In his police statement: He said the Bomb Disposal Unit entered after him to check the place.
In court: Yusri said he was not sure if the Bomb Disposal Unit entered Sirul’s apartment on Nov 7 last year.
Hasnal’s submission: This goes to the framing of the question as he would not have been sure as to when the bomb disposal unit went into the apartment (the bomb disposal unit was the last unit to inspect the apartment). There are no contradiction as far as the fourth element of contradiction is concerned.
SANTIAGO THREATENED BY THUGS AND HIS CAR DAMAGED
Klang is notorious for its thugs and gangsters. A staff of MPK resigned last year because thugs hassled him. They tried to raise their ugly heads yesterday and the victim was no other than the Klang Bandar Member of Parliament. Thank you for the onlookers who came to his aid. You just imagine yourselves being surrounded by 20 thugs. What a harrowing experience.
"I believe the attack is politically motivated because some of the thugs repeatedly shouted words in Tamil saying 'You all have taken out Datuk (Seri S.) Samy Vellu'," said Santiago.

KLANG (July 28, 2008) : Klang MP Charles Santiago, his wife, an aide and a friend's son were surrounded and shaken by a gang of about 20 thugs outside the Sri Muniandy Temple in Port Klang early Sunday morning.
"It was the most harrowing experience of my life and I dread to think what would have happened if not for the help of onlookers," said Santiago.
Santiago had earlier attended the temple's 25th anniversary celebration and later held a dialogue session with residents on crime prevention efforts in the area.
The session was jointly organised by Santiago, the police and the Klang Action Safety Committee.
"Many issues were raised, especially on gangsterism and the rising crime rate in Klang,” Santiago told theSun after lodging a report in the Klang police headquarters today.
"Just as we were about to leave, we were surrounded by the thugs who started intimidating us.
One of them pushed (D.) Sarah (Santiago's assistant) on her chest before jumping on my car boot. Another started kicking my car, breaking the driver’s side window and damaging the MP's crest on my car,” he said.
"Another thug threatened to kill my friend's son who started taking photos of the thugs."
Santiago said one the thugs had earlier parked a Mercedes Benz in front of the temple and blocked the road.
"I believe the attack is politically motivated because some of the thugs repeatedly shouted words in Tamil saying 'You all have taken out Datuk (Seri S.) Samy Vellu'," said Santiago.
"It's shocking that these thugs used the name of Datuk Samy Vellu in this senseless assault. The thugs fled the scene when several people who attended the dialogue rushed up to us," he added.
A Klang police spokesman confirmed the report and said the suspect had yet to be nabbed. Police are recording statements from witnesses and have classified the case as criminal intimidation.
