Tun Abdullah Ahmad Badawi today handed over premiership duties to his successor Datuk Seri Mohd Najib Abdul Razak in a modest ceremony witnessed by officers at the Prime Minister’s office and cabinet colleagues here. The ceremony was telecast live over RTM1 at 4pm.
Abdullah, who clocked five years, five months and three days as the fifth Prime Minister of Malaysia, looked at ease in a orange traditional outfit as he greeted Najib with a hug as the latter entered his room at 4.15pm.
Najib was accompanied by his wife Datin Seri Rosmah Mansor, both dressedin pink traditional Malay wear, and Chief Secretary to the Government Tan Sri Sidek Hassan. Abdullah and Najib then posed for press photographers before adjourning for a half-hour private meeting.
Before exiting his office of five years, Abdullah handed over a blue bound volume of the prime ministerial duties note to Najib before emerging at the main concourse of the building at 5pm to rousing applause.
After a short prayer, Abdullah and his wife Tun Jeanne and accompanied by Najib bade farewell to a crowd of department officers, staff and cabinet colleagues.
At 5.15pm, led by a team of security personnel, Abdullah and Jeanne accompanied by Najib and Rosmah made their way down the stairs of the department to a waiting black sedan which whisked them away just before 5.30pm.

The nation recorded history with the elevation of Najib to the post of prime minister when, for the first time, the post was filled by the son of a former prime minister. Najib's father, Tun Abdul Razak Hussein, was the country's second prime minister.
On Oct 8 last year, Abdullah announced that he would not defend the post of Umno president and would relinquish the post of prime minister in March this
year, thus hastening the transition of power to Najib earlier than the originally scheduled date of June 2010.
Last Saturday, Najib was officially declared Umno president, a post he had won unopposed, at the Umno General Assembly at the Putra World Trade Centre (PWTC) in Kuala Lumpur.
Yesterday, Abdullah, who had helmed the country for more than five years, had an audience with the Yang di-Pertuan Agong at the Istana Negara to hand over the letter elinquishing the post of prime minister and sought His Majesty's consent to appoint Najib as his successor.
Abdullah was appointed the fifth prime minister of the country on Oct 31 2003, and the handing-over of duties from Tun Dr Mahathir Mohamad to Abdullah had taken place at the same Prime Minister's Office, also on a Friday.

PAS mencabar Menteri Dalam Negeri menyaman Tun Dr Mahathir dan Tengku Razaleigh Hamzah (KuLi) yang turut mempertikaikan keputusan Sultan Azlan Shah melantik Dato' Dr. Zambry Abdul Kadir sebagai Menteri Besar Perak.
Setiausaha Agung PAS Pusat, Dato' Kamaruddin Jaffar menegaskan larangan itu bertujuan untuk melindungi Najib, yang baru sahaja dipilih menjadi Presiden Umno 27 Mac lalu.
"Kita (PAS) tidak faham dengan arahan Syed Hamid itu, apakah beliau cuba untuk menunjukkan kesetian kepada Najib agar tidak digugurkan dari kabinet?
"Jika ianya subjudis kenapa beliau tidak menyaman Dr Mahathir dan KuLi yang menulis dalam blog mereka mempertikaikan pelantikan Dato' Dr Zambry sebagai Menteri Besar," tegas beliau.
Larangan KDN itu tegas beliau mengambarkan ketakutan pihak BN untuk berhadapan dengan rakyat yang turut mempersoalkan pelantikan Dr Zambry dan tetap mengaitkan Dato' Seri Najib dengan pembunuhan Altantuya.
Kamaruddin juga menegaskan selepas mengantung Harakah dan Suara Keadilan, KDN berusaha untuk menyekat rakyat memperolehi maklumat melalui ceramah yang diadakan menjelang pilihan raya kecil 7 April nanti.
KDN mengeluarkan larangan mengejut kepada parti-parti bertanding di tiga kawasan pilihanraya kecil agar tidak membangkitkan isu pembunuhan Altantuya Shaariibuu dan keputusan kontroversi raja.

The new Minister brought in MACC to clean up the ministry after internal audit revealation was unsatisfactory. MACC is investigating claims that several documents were shredded just before Ismail took over the ministry in March last year.

The Malaysian Anti Corruption Commission (MACC) is investigating the records and accounts of the Youth and Sports Ministry following a request from its minister Datuk Seri Ismail Sabri Yaakob.
It is learnt the minister had ordered an internal audit of the ministry’s accounts over the past five years to detect financial excesses and abuse of funds which had left the ministry’s coffers all but empty, while it was under the watch of his predecessor Datuk Seri Azalina Othman Said.
Sources said Ismail had ordered the audit two months ago after failing to obtain any co-operation or satisfactory explanation from several ministry officers.
"However, he was not satisfied with the results of the internal audit and approached the MACC as well as the Auditor-General’s Chambers for assistance," said a source.
He said Ismail had warned staff and officers who had approved overspending and had spent on projects with suspect benefits to come clean or face the music.
"However, they refused to do so and the minister blew his top at one meeting and brought in the MACC to clean up the ministry," said the source.
It is understood that Ismail is also questioning the existence of several bodies set up during Azalina’s tenure, such as the National Fitness Council and the Women’s Sports and Fitness Foundation Malaysia, which had received millions of ringgit from the ministry.
"Ismail is adamant about cleaning up the ministry, and his approaching the MACC and AG was a last resort since he could not get any satisfactory answers," said a source.
Another source said the MACC had on Wednesday taken several documents from the ministry, including one pertaining to the purchase of a scoreboard for the Sukma Games, where the purchase and operations price of RM1 million was apparently inflated to RM11 million.
Other documents taken by the MACC included those pertaining to the poorly-received Champions Youth Cup (CYC) which Malaysia won a bid to stage for three years at RM17 million a year by paying bidding fees to a nearly out-of-business British promoter, as well as the National Sports Council (NSC) sports development fund which saw its RM500 million cash bank dwindle over the last few years.
MACC officials have been barred from revealing details of ongoing investigations but one high-placed source said the Commission is also investigating claims that several documents were shredded just before Ismail took over the ministry in March last year.
The source said a parallel MACC probe on the Tourism Ministry of which Azalina is the current minister is also taking into account similar allegations that several documents were destroyed following Azalina’s loss in her bid to retain a Supreme Council seat in last week’s Umno party polls.
"The investigations will look into whether the documents were disposed of on the minister’s directive or the sole actions of ministry officers," the source said.
At Press time, Ismail who is campaigning in Bukit Selambau, and MACC Commissioner Datuk Seri Ahmad Said Hamdan had yet to return calls and messages.

Laporan Buletin Utama TV3 semalam (1/4/2009) dan akhbar Utusan Malaysia hari ini (2/4/2009) mengenai keputusan Mahkamah Tinggi Ipoh menolak permohonan Speaker Dewan Undangan Negeri (Dun) Perak, V Sivakumar untuk membatalkan saman terhadapnya oleh tiga Ahli Dewan Undangan Negeri (Adun) Bebas tidak menggambarkan keputusan sebenar Mahkamah Tinggi tersebut.
Utusan melaporkan seperti berikut:-
IPOH 1 April - Mahkamah Tinggi di sini hari ini menolak permohonan Speaker Dewan Undangan Negeri (Dun) Perak, V Sivakumar untuk membatalkan saman terhadapnya oleh tiga Ahli Dewan Undangan Negeri (Adun) Bebas.
Keputusan ini secara tidak langsung membolehkan ketiga-tiga Adun Bebas iaitu Jamaluddin Mohd Radzi (Behrang), Kapt (B) Mohd Osman Jailu (Changkat Jering) dan Hee Yit Foong (Jelapang) kekal sebagai wakil rakyat dan kerusi bagi DUN berkenaan tidak kosong.
Laporan di atas khususnya perenggan yang menyatakan "keputusan ini secara tidak langsung membolehkan ketiga-tiga Adun Bebas iaitu Jamaluddin Mohd Radzi (Behrang), Kapt (B) Mohd. 1. Mahkamah Tinggi Ipoh hanya menolak permohonan Sivakumar bagi membatalkan saman pemula yang difailkan oleh ketiga-tiga Adun tersebut ke atas beliau.
2. Keputusan Mahkamah Tinggi menolak permohonan Sivakumar tidak bermakna mahkamah mengisytiharkan ketiga-tiga Adun Bebas itu kekal sebagai wakil rakyat dan kerusi bagi Dun berkenaan tidak kosong kerana isu tersebut belum didengar dan diputuskan oleh Mahkamah.
3. Apabila Hakim mendengar mana-mana permohonan untuk membatalkan saman (sama ada Writ Saman atau Saman Pemula - dalam kes ini ianya adalah Saman Pemula) yang mana permohonan tersebut dibuat di bawah Aturan 18 Kaedah 19 Kaedah-Kaedah Mahkamah Tinggi 1980 (juga dikenali sebagai permohonan "to strike out pleading"), hakim hanya memutuskan permohonan tersebut sahaja. Ini bermakna di dalam kes di Ipoh, hakim hanya memutuskan sama ada membenarkan permohonan Sivakumar atau menolak permohonan Sivakumar bagi membatalkan Saman Pemula ketiga-tiga Adun tersebut.
4. Di dalam kes ini Mahkamah memerintahkan permohonan Sivakumar bagi membatalkan Saman Pemula ketiga-tiga Adun tersebut ditolak. Itu sahaja perintah yang Mahkamah berikan. Tiada perintah lain diberikan oleh Mahkamah Tinggi Ipoh.
5. Selepas Mahkamah memerintahkan permohonan Sivakumar bagi membatalkan Saman Pemula ketiga-tiga Adun tersebut ditolak, Mahkamah yang sama telah menetapkan untuk meneruskan pendengaran Saman Pemula yang difailkan oleh ketiga-tiga Adun Bebas tersebut dan tarikh pendengaran Saman Pemula telah ditetapkan pada 8 April 2009 ini.
6. Selagi Mahkamah belum mendengar dan memutuskan isu yang dibangkitkan di Saman Pemula yang difailkan oleh ketiga-tiga Adun tersebut, ketiga-tiga mereka belum boleh dikatakan sebagai wakil rakyat yang sah dan kerusi mereka juga tidak boleh dikatakan tidak kosong seperti mana yang dilaporkan oleh TV3 dan Utusan Malaysia.
7. Pasukan Peguam Sivakumar telah memutuskan untuk memfailkan rayuan ke atas keputusan Mahkamah Tinggi Ipoh tersebut dan terdapat kemungkinan besar keputusan Mahkamah Tinggi Ipoh tersebut akan diketepikan oleh Mahkamah Rayuan kelak seperti mana Mahkamah Rayuan mengenepikan keputusan Hakim Mahkamah Tinggi Ipoh, Dato' Ridzuan yang melarang Sivakumar diwakili oleh peguam.
Saya harap penjelasan di atas dapat sedikit sebanyak membetulkan salah faham para pembaca di atas laporan putar belit TV3 dan Utusan Malaysia di atas.

High Court allows A-G to be intervener in suit
IPOH (April 2, 2009) : The High Court here today allowed the application by Attorney-General Tan Sri Abdul Gani Patail to be an intervener in the suit brought by Mentri Besar Datuk Zambry Abdul Kadir and his six state executive councillors against Perak State Assembly Speaker V. Sivakumar for suspending them from state assembly sittings.
Sivakumar, as chairman of the state assembly’s rights and privileges committee, had suspended Zambry and the six executive councillors for 18 months and 12 months each, respectively, for contempt of the House.
Zambry and the exco members are suing Sivakumar for making an illegal ruling and contend that they should be allowed to attend the state assembly sittings.
High Court judge Datuk Wan Afrah Wan Ibrahim made the ruling after hearing the arguments by lawyers for Sivakumar and Gani.
Sivakumar’s lead lawyer, Tommy Thomas, had argued that the suit is between the legislator and members of the House and has nothing to do with the executive participation in the case.
However, Gani argued that as he is the "guardian of public interest", he has an interest in the case.
In the afternoon, Thomas urged the court to strike out the application by Zambry and the exco members against Sivakumar "as the proceedings of the legislative assembly are beyond judicial scrutiny".
He said Article 72 of the Federal Constitution, read together with paragraph 3 of the Legislative Assembly (Privileges) Enactment 1959, makes it clear that as members of the legislative assembly, the proceedings are protected by immunity from civil or criminal proceedings "for anything said or done".
Thomas said the order to suspend Zamry and the exco members was adopted by the state assembly sitting under a tree on March 3, "which is legal in law".
Wam Afrah fixed April 9 for the continuation of the hearing.
Today's court proceedings were held behind closed doors and the media and public were barred from the hearing.
Nga Hock Cheh, one of the laweyers representing Sivakumar, briefed the media on the hearing after the postponement of the case.
In addition to Thomas and Nga, the lawyers appearing for Sivakumar were Chan Kok Keong, Leong Cheok Keng and Mohd Asri Osman.
Zambry and the exco members were represented by Datuk Mohd Hafarizam Haron, Firoz Hussein Ahmad Jamaluddin , Abu Bakar As-Sidek Mohd Sidek, Badrul Hishah Abdul Wahap, Faizul Hilmy Ahmad Zamri and Syed Faisal Syed Abdullah.

Baru-baru ini terdapat banyak skandal yang mengaitkan nama YAB Timbalan Perdana Menteri seperti komisyen pembelian kapal selam Scorpene yang melibatkan negara Perancis. Yang paling mengejutkan adalah peristiwa pembunuhan seorang wanita Mongolia yang dikatakan turut mengaitkan nama beliau. Perkara di atas telah tersebar ke seluruh dunia dan diulas di banyak akhbar dan majalah seluruh dunia.
Oleh kerana perkara di atas begitu banyak diperkatakan dan memandangkan jawatan Perdana Menteri begitu penting buat negara ini, adalah amat wajar sekiranya Seri Paduka Baginda menangguhkan lantikan Perdana Menteri yang baru ini sehingga segala dakwaan berkenaan disiasat oleh sebuah Suruhanjaya Bebas dan nama beliau dibersihkan demi menjaga maruah negara ini.

Pakatan Rakyat memohon limpah restu Yang di-Pertuan Agong, Tuanku Mizan Zainal Abidin agar menangguhkan pelantikan Dato' Seri Mohd Najib Tun Razak sebagai Perdana Menteri Malaysia yang keenam, yang dijadualkan jam 10 pagi esok.
Dalam surat yang dihantar ke Istana Negara, Pakatan Rakyat memohon YDP Agong membuat penangguhan itu supaya beliau disiasat dan dibersihkan terlebih dahulu daripada pelbagai tuduhan yang dihadapkan kepada Timbalan Perdana Menteri.

Ahli Parlimen Jerai, Ustaz Firdaus Jaafar menyelar Barisan Nasional dan menyifat slogan yang digunakan untuk menarik sokongan rakyat di Bukit Selambau dan Bukit Gantang sebagai satu lagi sandiwara terdesak BN untuk menipu rakyat.
Beliau mempersoalkan mengapa pada waktu kritikal disaat sokongan rakyat terhadap BN terhakis, baru BN hendak memohon restu rakyat.
"Kenapa semasa menaikkan harga minyak, menaikkan harga barang, naikkan tol dan merampas kerajaan negeri Perak, BN tidak meminta restu rakyat?" soal beliau.
Firdaus yang juga Ketua Penerangan Pilihan Raya bagi jentera PAS percaya rakyat di Bukit Selambau dan Bukit Gantang tidak akan mudah tertipu dengan sandiwara BN.
Katanya, BN seolah-olahnya seperti 'harimau kelaparan yang tersepit' yang akan membaham orang yang melepaskannya.
"Rakyat jangan tertipu lagi, jika mereka tersilap memberikan kemenangan kepada BN, mereka akan terus ditindas," tegasnya.
Firdaus yang juga AJK Dewan Pemuda PAS Pusat turut membidas Menteri Pelajaran, Dato' Seri Hishamuddin Hussein yang mempergunakan Sekolah Rendah Lubuk Segentah dekat sini untuk kepentingan politik BN.
"Tindakan Naib Presiden Umno ini cukup memalukan, beliau membawa calon BN pergi ke sekolah rendah untuk berkempen.
"Tindakan menggunakan premis kerajaan ini membuktikan BN sedang terdesak kerana menyedari rakyat masih menolak mereka sejak PRU 2008," ujarnya.
Katanya, Hishammuddin dan pemimpin kerajaan lain, kononnya melarang parti-parti politik menggunakan premis kerajaan, sebaliknya mereka yang memperalatkan dan menyalahgunakan kedudukan untuk kepentingan BN.
"Rakyat harus menghentikan double standard ini dengan mengundi calon Pakatan Rakyat," tegasnya.

The trip to Disneyland in Paris between Dec 17 and 24, 2004, Khairiyah said PNSB spent almost RM1 million as the visit included a working trip to Morocco to study Moorish and Islamic architecture and a four-day transit stop in Dubai (costing more than RM90,000).
The entourage merely visited the theme parks as members of the public and that the visits were more as an exposure to the management and concept of running a theme park.
The decision was made at PNSB’s management meeting and by chairman and former MB Mohd Khir.
Khairiyah also told Selcat that no report was submitted on the technical trips to Disneyland.
"Mohd Khir and his wife refused to turn up and explain to the people what happened to Balkis and PNSB all these years," according to Teng, the chairman of SELCAT.
On the exposure of these dubious visits to disneylands, some of the members of the Malaysian public may comment that" it was alright, he was such a smart guy, and afterall he was the MB of Selangor then, he knew what he was doing. He did it with the best of intention. Selangor, being a negeri Maju, could afford such a lavish spending. If you were in his position you might do even worst than that."
Well, there are still some Malaysian with that sort of mentality. Some even commented in my blog as saying " you are putting sand in his rice plate". Well....
Khir's RM1.7m Disney trips Alone
Former Selangor Mentri Besar Datuk Seri Dr Mohd Khir Toyo and his entourage spent RM1.7 million of public funds to visit two Disneyland theme parks in the United States and France, but the working trips did not include meetings with Disneyland officials and no reports were submitted after that.
These trips which took place to visit two Disneyland theme parks in the United States and France were in addition to two other trips to Disneyland parks in Hongkong in March 2006 for which the entourage spent RM30,000 and Tokyo, in preparation for the setting up of a 8ha theme park in Bagan Lalang.
State investment arm Permodalan Negeri Selangor Bhd (PNSB) paid for these trips, its chief executive officer Datin Khairiyah Abu Hassan told the Selangor Select Committee on Competency, Accountability and Transparency (Selcat) which today wrapped up its inquiry into the expenses of the now-defunct elected Selangor representatives' wives' welfare and charity organization (Balkis) and the excesses of state-linked companies.
The inquiry started on March 23. The findings will be to the state assembly in July.
Grilled by committee members, Khairiyah testified that the entourage merely visited the theme parks as members of the public and that the visits were more as an exposure to the management and concept of running a theme park.
Asked who decided on the trips, she said the decision was made at PNSB’s management meeting and by chairman and former MB Mohd Khir.

> More than RM366,000 was spent on a reconnaissance trip in preparation for the working visit to Morocco while RM416,000 was spent for the official delegation.
> The RM646,841 trip to the United States between Dec 23, 2007 and Jan 1, 2008 included technical visits to Disneyland in Orlando and Miami beach after which the entourage flew to Honolulu, Hawaii, where they went on a city tour, visited the Pearl Harbour and Chinatown, watched a cultural show and went on a dinner cruise. The group also visited the Kennedy space centre to see how this concept could be included in the Bagan Lalang theme park.
> PNSB paid RM110,000 for a suite room for Mohd Khir, his wife and three children at the Hilton Waikiki Hotel and the Walt Disney Dolphin Hotel prior to that.
Selcat chairman Teng Chang Khim remarked: "This is equivalent to RM10,000 a night throughout the seven day visit."
On the Dubai transit during the Paris trip, Teng asked why a transit took four days.
He also questioned the need for a reconnaissance team to go ahead of the official delegation when this could have been done by the Malaysian embassy in France.
Khairiyah also told Selcat that no report was submitted on the technical trips to Disneyland.
Although there were invoices to show that the cost of accommodation and airfare for the children of Mohd Khir were absorbed by PNSB, Khairiyah said this was paid back to PNSB.
However, Selcat member Azmin Ali challenged her, saying there was no proof of this.
Questioned by Azmin whether the trips were leisure trips instead of working trips as the trips took place in December, Khairiyah said she did not know the rationale behind the trips.
Khairiyah also said the company RM58,362 for a trip to China for a car show of which almost RM39,999 was spent on Mohd Khir alone.
She said the trip was organised for Mohd Khir to accompany the Sultan to the show and added that the expenditure incurred came out of PNSB chairman’s annual vacation budget which is RM40,000.
Azmin read out the itinerary which was vague and only outlined breakfast, lunch and dinner with a golf game thrown in during the five day programme.
Khairiyah also said that PNSB spent RM38,000 for a trip to Indonesia for study trip in the batik industry which included stays in expensive hotel suites and post luxury car rentals among others.
The idea was to implement a similar industry in Selangor, however it never took off, she said, adding that Mohd Khir was accompanied by Zahrah, a child and their maid.
At the end of the inquiry, Teng said the first public hearing to be held by a legislative body was smooth except that two key witnesses failed to turn up.
"Mohd Khir and his wife refused to turn up and explain to the people what happened to Balkis and PNSB all these years," he said.
Teng said Mohd Khir will be referred to the committee of privileges for failure to attend the hearing while Zahrah can be prosecuted under Section 5 of the Contempt of the House Act 2008. "However, she can only be prosecuted with the consent of the Attorney General."
Teng also disclosed that the Registrar of Societies (ROS) refused to produce crucial documents which are accessible to the public and not deemed as official secrets.
He said under Section 114(g) of the Evidence Act, this raises presumptions against the ROS, that the facts in the documents are unfavorable to certain persons.
"There is no reason for the ROS not to produce it unless it is a false document," he added.

Perubahan yang diuar-uarkan oleh pemimpin Umno selepas pemilihan parti itu baru-baru ini tegas beliau tidak berlaku sebaliknya pelbagai masalah sedang dihadapi kesan dari keputusan pemilihan tersebut.
"Apa yang berubah kalau pemimpin yang disahkan oleh Lembaga Displin Umno sendiri pun masih boleh menang dalam merebut jawatan Ketua Pemuda Umno."
"Perubahan yang mereka gembar gemburkan itu hanyalah semata-mata untuk menutup pergolakan yang sedang berlaku dalam Umno," tegas beliau.
Pergolakan yang masih berlaku dalam Umno itu tegas Haron Din membuktikan Umno kini semakin lemah dan terpaksa memainkan isu-isu yang remeh dalam usaha mereka untuk menawan kembali kerusi parlimen Bukit Gantang.
Umno tegas beliau, masih lagi terpaksa memainkan isu-isu perkauman dan menakutkan rakyat kerana jika tidak menggunakan cara tersebut mereka akan mengalami kekalahan besar.
Beliau menegaskan demikian dalam satu Forum Perdana sempena kempen pilihanraya kecil Bukit Gantang yang diadakan di sini baru-baru ini.
Selain beliau, Dato' Tuan Ibrahim Tuan Man dan Ustaz Badrul Amin turut menjadi ahli panel forum tersebut yang dipengerusikan oleh Ustaz Idris Ahmad.
Haron Din juga menegaskan pengundi di Bukit Gantang harus bijak membuat pilihan sama ada mahu memilih pemimpin dari parti yang semakin tidak diyakini atau pemimpin dari parti yang memperjuangkan keadilan dan ketelusan untuk semua rakyat.
Justeru itu beliau berharap agar pengudi-pengudi di Bukit Gantang tidak terpengaruh dengan segala dakyah yang dibuat oleh Umno dan membuat pilihan dengan bijak.

SHAH ALAM, 31 Mac (Bernama) -- Pensyarah Fakulti Undang-undang Universiti Teknologi MARA Dr Shad Saleem Faruqi mengesyorkan supaya Barisan Nasional (BN) dan Pakatan Rakyat duduk semeja dan berunding bagi menyelesaikan kemelut politik di Perak.
Beliau berkata usaha menyelesaikan kemelut itu menerusi mahkamah boleh menjadi salah satu jalan penyelesaian yang sesuai, namun ia dijangka akan mengambil masa yang panjang kerana ia pasti disusuli dengan rayuan demi rayuan terhadap setiap ketetapan yang dibuat mahkamah.
Dr Shad berkata demikian ketika menyuarakan pandangannya dalam Rancangan Hujah yang disiarkan di TV9 malam ini, dan antara panel yang turut menyertai perbincangan dengannya dalam rancangan itu ialah peguam terkenal Datuk Mohd Shafee Abdullah (foto kanan) dan Presiden Majlis Peguam Malaysia Ragunath Kesavan (foto kiri).
Rancangan Hujah dipengerusikan oleh Pensyarah Kanan Pusat Pengajian Sejarah, Politik dan Strategi Universiti Kebangsaan Malaysia Dr Mohammad Agus Yusoff.
Sementara itu Mohd Shafee berkata kemelut politik di Perak boleh diselesaikan sekiranya proses mahkamah dapat dipercepatkan, manakala Ragunathan berpendapat masalah ini boleh diselesaikan dengan mengadakan pilihan raya bagi mendapatkan mandat baru rakyat.
Perak ketika ini berhadapan dengan kemelut politik apabila bekas Menteri Besar Datuk Seri Mohammad Nizar mengemukakan saman dan mencabar kesahihan pelantikan Datuk Dr Zambry Abdul Kadir sebagai Menteri Besar Perak yang baru.
Mohammad Nizar, yang merupakan Timbalan Pesuruhjaya PAS Perak itu mengemukakan permohonan bagi mendapatkan pengisytiharan bahawa beliau adalah Menteri Besar Perak yang sah selain untuk mendapatkan injunksi menghalang Dr Zambry daripada melaksanakan tugas sebagai Menteri Besar.

KUALA LUMPUR, 5 Feb (Bernama) — Sultan Perak berkuasa memecat Menteri Besar sekalipun MB enggan meletak jawatan selepas diperintahkan berbuat demikian, kata seorang pakar perlembagaan hari ini.
Bagaimanapun, kuasa berbuat demikian tidak terdapat dalam peruntukan perlembagaan negeri Perak tetapi daripada Akta Interpretasi yang menyatakan kuasa melantik termasuk kuasa memecat, kata Prof Dr Shad Saleem Faruqi.
“Artikel 16 Fasal 7 Perlembagaan Negeri Perak menyebut seseorang anggota majlis selain MB (Menteri Besar) memegang jawatan atas perkenan Sultan. Dengan lain perkataan, MB tidak boleh dipecat.
“Tetapi Artikel 16 Fasal 6 menyebut jika beliau hilang kepercayaan beliau mesti meletak jawatan. Jadi kawasan kelabu ialah apa berlaku jika beliau tidak meletak jawatan,” katanya bila dihubungi Bernama hari ini.
Beliau berkata dua peruntukan yang berasingan nampaknya bercanggah jadi seseorang itu perlu melihat di luar Perlembagaan Perak dan kepada Akta Interpretasi, yang menyebut kuasa untuk melantik termasuk kuasa memecat.
“Dalam situasi di mana orang berkenaan (MB) tidak mahu berundur tetapi kalah, Sultan mempunyai kuasa untuk memecat.
“Saya yakin baginda tidak suka (memecat MB) tetapi seluruh dunia memerhati, kerajaan tumbang bukan kerana mandat popular tetapi akibat perbuatan melompat parti.
“Saya yakin Tuanku amat dukacita dengan semua ini, tapi baginda dalam dilema, baginda perlu mempunyai sebuah kerajaan tetapi terdapat kebuntuan jelas,” kata beliau.
Prof Shad Saleem berkata beliau lebih suka kepada pembubaran (dewan negeri) untuk membolehkan rakyat buat keputusan tetapi langkah itu melibatkan belanja besar dan gangguan yang membebankan rakyat, yang pastinya telah diambil kira oleh Sultan semasa membuat keputusan.
Profesor itu diminta mengulas keengganan MB Perak Datuk Seri Mohammad Nizar Jamaluddin meletak jawatan walaupun setelah diarah berbuat demikian dengan segera oleh Sultan Azlan Shah.
Satu kenyataan dari pejabat Sultan Perak berkata jika Mohammad Nizar tidak berundur, jawatannya sebagai Menteri Besar Perak bersama jawatan anggota-anggota exco negeri akan dianggap telah dikosongkan.
Prof Shad Saleem bagaimanapun berkata keengganan Mohammad Nizar itu bukan satu kesalahan yang boleh dikenakan hukuman.

Distinguished guests, learned colleagues and valued friends:
This moment is a “dream moment” for me, and I wish to thank you all from the bottom of my heart for making it so memorable for me.
I am just an ordinary law teacher in the evening of my career. Everyday I watch the shadows lengthening and the hues of the sunset growing deeper. But your kind presence here makes the colours of dusk appear brighter and lovelier and gives me that warm feeling that perhaps 37 years as a law teacher were worth it and not wasted.
It was not my expectation that my publisher would so generously organise something so grand. And it was beyond my imagination that Y.A.A. Tun and the nation’s leading judges, jurists and legal luminaries would add grace and grandeur to this occasion.
But I was emboldened to approach Y.A.A. Tun because of a chance meeting I had with Tun at UiTM’s campus in Merbok, Kedah where Tun had gone to deliver an address to our students. Tun’s humility and humanity, simplicity and integrity shone through. And so, despite some nervousness, I approached Tun’s chambers for an appointment. It is a measure of our Chief Justice’s prompt attention to detail that less than 24 hours after I contacted Tun’s chambers, Tun personally sent a very warm e-mail message to say – and these were his words – “that he felt honoured to accept my invitation”.
I am deeply grateful to Tun and I feel honoured and blessed beyond what I can describe.
I also wish to say that it has been my privilege to be associated with the teaching of constitutional law at UiTM for the last three and a half decades. I have been assigned other subjects as well – contract, tort, administrative law, family law, clinical legal education, jurisprudence – but none of the subject arouse the awe and the sense of semi-sacredness that I feel when I lecture on the glittering provisions of the Constitution.
This is because I see the Constitution not just as a lawyer’s document but also as the vehicle of a community’s legal, political and social life. More than any other law, a Constitution is the repository of the nation’s dreams and demands, its values and vulnerabilities. It provides the foundation on which the superstructure of the state rests. It creates our basic institutions and vests them with powers and responsibilities. It protects fundamental freedoms. It seeks to reconcile the irreconcilable conflict between the might of the state and the rights of the citizens.
As the years passed and my immersion in constitutional law deepened, I began to see its majesty, its beauty, its contradictions, its flaws, its historical antecedents and its complexity.
Each year, as I ended the course, the islands of knowledge began to grow. And as the islands of knowledge began to grow, the shorelines of mystery began to expand.
Despite three and a half decades, I still feel like the child at the seashore with just a few pebbles in my bag and a vast ocean of knowledge stretching right up to the horizon beyond me.

I present this work to you with great hesitation and nervousness. Despite its 47 chapters and 800 pages, it is incomplete. The views I have expressed in it are subjective and flawed despite my sincere efforts at a dispassionate analysis.
I am deeply conscious that to comment objectively and fairly on the state of constitutionalism and human rights in any country is not an easy task because the Constitution is silhouetted against the panorama of history, politics, economics, culture and philosophy. A mature analysis requires a historian’s perspective, a lawyer’s acumen, a politician’s insight, a philosopher’s vision and the executive’s experience. Unfortunately I lack all these attributes.
Y.A.A. Tun and our distinguished judges:
Because of the veneration I feel for the Constitution, there is also a sense of veneration I feel for the institution of the judiciary.
I am aware that many continental countries do not place the judiciary at the heart of the legal system. But being a child of the common law tradition, I see the judiciary as a vital component of our constitutional arch. I see the judiciary as the bulwark of our liberties and protector and guardian of values on which a democratic, rule-of-law society thrives.
I have to confess that my book subscribes to an activist role for the judiciary. I believe – though mistaken I may be in this belief – that throughout the world there has been a massive enlargement of the bureaucratic apparatus of the state. The traditional parliamentary techniques for providing a check and balance and for supervising the administration are not working well. Therefore, it is imperative that judicial control over the administration must be proportionally strengthened. “As liberty is subtracted, justice must be added”.
I am aware that judicial activism has its critics even in the land of Marbury v Madison. But I believe that in the area of constitutional law, judicial activism is unavoidable.
This is because the Constitution consists of glittering generalities and wisdoms of the past that could not possibly calculate for the felt necessities of today and of posterity. The Constitution has, therefore, to be interpreted to keep pace with the march of times, to stay sensitive to the rise and fall of ideas and to remain abreast of the tides that continue to wash at our shores.
Secondly, life is larger than the law. Now and then novel situations arise on which the law provides no guidance. The judge has two choices. He can wring his hands in despair. Alternatively, he can, as Justice Bhagwati put it poetically, “reach out into the heart of legal darkness where the flames of precedent fade and flicker”, and “extract from there some raw materials with which to fashion a signpost to guide the law”. The contemporary philosopher, Ronald Dworkin, gives similar advice in situations when rules run out. According to him, the judge can rely on “non-rule standards”, principles, doctrines and standards to assist in the decision. These non-rule standards then become an integral part of the majestic, seamless web of the law. A constitutional court judge is entitled to view the whole matrix of the law in arriving at his decision.
My Lords, I believe that the broad definition of “law” in Article 160(2) of the Federal Constitution lends credence to the argument for a holistic view of legal practice.
Thirdly, it is a fact that the law of the Constitution is often so full of ambiguities, gaps and conflicts that the judge has to reach out beyond formal rules to seek a solution to the problem at hand.
Fourth, when the declared law leads to unjust or undesirable results or raises issues of public policy or public interest, judges around the world try to find ways of adding moral colours or public policy shades to the legal canvas. One could note, for instance, the “public interest” interpretation of Article 5(3) of the Federal Constitution in Ooi Ah Phua v Officer Incharge Kedah/Perlis [1975] 2 MLJ 198 in which the constitutional right “to consult and be defended by a legal practitioner of his choice” was judicially interpreted to come alive only after police have completed their investigation.
Fifthly, provisions enacted in one age have to be applied in a time frame of the continuum to problems of another age. A present time-frame interpretation to a past time-frame statute invariably involves the judge in a time-travel from the past to the present. He has to cause the provision to leap-frog decades or centuries in order to apply it to the felt necessities of the times.
In sum even if it is argued that a judge has to interpret the law according to the intention of the legislature (which intention is often not clearly defined), it is nevertheless true that the interpretive task is, in its functioning if not in its form, virtually indistinguishable from the law creating task. As Justice Holmes pointed out: “A word is not a crystal, transparent and unchanged. It is the skin of a living thought and may vary greatly in colour and content according to the circumstances and the time in which it is used. It is for the judge to give meaning to what they legislature has said.”
If one adopts a holistic view of the concept of law, as many legal philosophers urge us to do, that leads to the inevitable conclusion that the judge is free to view the entire spectrum of the law in its full majesty; to subject all statutes to constitutional fundamentals; to read rules of one statute in the light of the related statutes and relevant precedents; to understand law in the background of a wealth of presumptions, principles, doctrines and standards which operate in a democratic society. The judge is entitled to look at the totality of the laws, institutions, moral standards and objectives on which his society is based. He is justified in giving effect to what is implicit in the legal system and to crystallize what is inherent. His task is creative and not passive.
I acknowledge, however, that within the academic and judicial community there are animated disagreements on the proper approach to statutory interpretation and there is no unanimous answer. Ultimately it is a question of political and legal philosophy.
Leaving the issue of statutory interpretation, I wish to comment on the storms that buffeted the judiciary before Tun’s assumption of office and the very dignified and exemplary manner in which Tun has tried to restore the dignity of, and confidence in, the judicial institution. We, as citizens, wish to thank Tun for giving us good leadership in challenging times.
To your brother and sister judges too we have to say that your learned judgments are a learning experience for all of us in the academia and they contribute to the building blocks of our knowledge.
Thank you for protecting our Constitution. Despite its many flaws it is a wise and workable document. It bears the mark of idealism as well as realism. It blended the old and the new, the indigenous and the imported. According to our late and great constitutionalist, Prof Hickling, the ideas of Westminster and the experience of India mingled with those of Malaya to produce a unique form of government.
Fifty years into Merdeka, the Federal Constitution, though amended significantly in many parts, is still the apex of the legal hierarchy. It has endured. It has preserved public order and social stability. It has provided the framework for Malaysia’s spectacular economic prosperity. It has reconciled the seemingly irreconcilable conflict of interest between ethnic and religious groups in a way that has few parallels in the modern world.
Finally I wish to thank The Star for its generosity in organizing this occasion; its community-mindedness in printing this book on constitutional law at a very reasonable price; and its continued opportunity to me through its columns to try to promote constitutional literacy and to bring the Constitution into every home and into every heart. Pada 29 Mac 2009 Kamarul Ramizu Idris, 42, seorang usahawan, satu-satunya calon bebas bagi PRK P59 bertanding kerana mahu menanam konsep 'politik beriman' dan menolak sikap taksub kepada parti politik tertentu jika mahu membangunkan negara. Beliau mengaku tidak pernah melibatkan diri dalam mana-mana parti politik.
Dua hari kemudian, pada 31 Mac 2009, Kamarul Ramizu dalam manifestonya berhasrat untuk mewujudkan Parti Iman Semalaysia (PIS) tanpa mengira sama ada menang atau kalah dalam pilihan raya itu.
Komen saya: Baru dua hari sudah tukar pendirian. Seminggu lagi, mungkin tarik diri dan isytihar masuk parti tertentu.
Inilah antara senarai sindrom dan penyakit umat Islam di seluruh dunia iaitu , jahil muraqab tentang agama (deen) yang dianuti, mudah terpedaya dengan muslihat musuh, sifat hasad dengki yang tebal dan tergesa-gesa dalam tindakan tanpa usul periksa serta kajian.

Konsep 'Politik Beriman' Jadi Hasrat Calon Bebas Bukit Gantang
TAIPING, 29 Mac 2009. Hasrat mahu menanam konsep 'politik beriman' dan menolak sikap taksub kepada parti politik tertentu, menjadi faktor pendorong calon bebas dalam pilihan raya kecil Parlimen Bukit Gantang.
Atas prinsip itulah Kamarul Ramizu Idris, 42, seorang usahawan menyerahkan borang penamaan calon di Dewan Majlis Perbandaran Taiping di sini hari ini dan memilih payung sebagai lambang parti Bebas pada pilihan raya kecil itu.
"Konsep politik beriman ini akan menyatu-padukan rakyat. Selain itu setiap agama percaya kepada Tuhan dan jika percaya kepada Tuhan maka perlu tolak sifat taksub kepada parti. Tolak taksub kepada parti kalau mahu membangunkan negara," katanya kepada pemberita ketika ditemui di sini.
Tidak pernah melibatkan diri dalam mana-mana parti politik, Kamarul Ramizu juga yang mendakwa dirinya sebagai pakar motivasi yang mempunyai kem di Cameron Highlands, Parit dan Gua Tempurung, berkata beliau akan berkhidmat dengan penuh beriman sekiranya dipilih oleh pengundi Bukit Gantang sebagai wakil rakyat.
"Saya tidak gentar dalam apa jua keadaan. Saya yakin dengan Yang Maha Esa yang membenarkan kehidupan kita terus sempurna. Saya tidak ditaja oleh sesiapa dan berjaya atas kewangan sendiri," katanya.
Beliau berkata kemelut politik di Perak dan pertelagahan antara pemimpin parti politik yang bertanding akan beri kelebihan kepadanya yang pertama kali bertanding dalam pilihan raya.
Kamarul Ramizu berkata beliau akan menggunakan cara mengedarkan risalah selain pergi rumah ke rumah bagi meraih undi semasa tempoh sembilan hari kempen sebelum hari pengundian 7 April ini.
Selepas selesai penamaan calon, Kamarul Ramizu disambut kira-kira 50 penyokongnya yang kesemuanya berpakaian dan berpayung hitam beserta laungan slogan 'Allah, Muhammad' beberapa kali.
Pada pilihan raya kecil itu Kamarul Ramizu akan berhadapan calon BN Ismail Saffian, 49, dan calon PAS Datuk Seri Mohammad Nizar Jamaluddin, 52.

Calon Bebas Bukit Gantang Muncul Dengan Poster, Manifesto

TAIPING, 31 Mac (Bernama) -- Dua hari selepas penamaan calon, sepanduk calon Bebas bagi pilihan raya kecil Parlimen Bukit Gantang Kamarul Ramizu Idris, 42, dengan slogan "Kembali Beriman Kembali Al-Quran" mula kelihatan di sekitar Changkat Jering.
Kamarul Ramizu berkata beliau mengambil sikap mendiamkan diri selepas hari penamaan calon Ahad lepas kerana menyiapkan kelengkapan kempen seperti poster dan sepanduk, yang mengambil masa sehingga hari ini.
"Dalam dua hari ini, sepanduk dicetak dan saya perlu menyiapkan beberapa perkara sebelum memulakan kempen meraih sokongan pengundi esok," katanya ketika ditemui Bernama bersama lima pembantunya di Changkat Jering, di sini, Selasa.
Beliau berkata cara mengedarkan risalah manifesto dan kempen dari rumah ke rumah bagi meraih undi akan digunakan sepanjang tempoh kempen lapan hari sebelum hari pengundian 7 April ini.
Kamarul Ramizu, seorang usahawan, berkata pendekatan berkempen dari rumah ke rumah itu digunakan memandangkan cara itu memberikan pengaruh yang lebih berkesan.
"Itu lebih berkesan dengan cara bersemuka dengan orang kampung (pengundi), mudah untuk rapat dengan mereka dan lebih jelas diadakan dalam perhimpunan kumpulkan orang kampung melalui ceramah kecil-kecilan," katanya.
Menurutnya petugasnya yang seramai 200 orang akan bergerak serentak dari rumah ke rumah di sekitar kawasan pedalaman untuk menemui semua lapisan pengundi tanpa mengira kaum dan agama termasuk mengedarkan risalah manifestonya.
Pada pilihan raya kecil itu Kamarul Ramizu memilih payung sebagai lambang parti Bebas yang akan berhadapan calon BN Ismail Saffian, 49, dan calon PAS Datuk Seri Mohammad Nizar Jamaluddin, 52.
Beliau yang berasal dari Jalan Menteri Pokok Asam di sini mendakwa dirinya sebagai pakar motivasi yang mempunyai kem motivasi di Cameron Highlands, Parit dan Gua Tempurung, tetapi tidak pernah melibatkan diri dalam mana-mana parti politik.
Konsep 'politik beriman' dan menolak sikap taksub kepada parti politik tertentu, menjadi faktor pendorong calon Bebas itu bertanding selain berhasrat untuk berkhidmat dengan penuh beriman sekiranya dipilih oleh pengundi Bukit Gantang sebagai wakil rakyat.
Beliau berkata bajet tidak menjadi faktor penghalang, tetapi berbekalkan kekuatan tauhid dan niat sebagai pemimpin beriman akan membenarkan dan memberikan kemenangan kepada pihak yang sepatutnya.
Kamarul Ramizu dalam manifestonya berhasrat mewujudkan Parti Iman Semalaysia (PIS) tanpa mengira sama ada menang atau kalah dalam pilihan raya itu; menubuhkan badan khas mengimarahkan dewan masjid, badan khas rakyat dan kepimpinan Rasulullah S.A.W. serta para sahabat agar menjadi pedoman bagi kegemilangan masyarakat beriman.
"Strategi saya adalah mewujudkan masyarakat beriman yang sentiasa bersyukur, sabar dan mengingati Allah. Jika ini terjadi maka pembangunan dapat diselaraskan dengan peruntukan yang disediakan bagi melaksanakannya," katanya.
Pilihan raya kecil itu diadakan berikutan kematian penyandangnya Roslan Shaharum daripada PAS pada 9 Feb lepas akibat serangan jantung.
Pada pilihan raya umum 8 Mac tahun lepas, Roslan menang dengan majoriti 1,566 menewaskan calon BN Datuk Seri Abdul Azim Mohd Zabidi serta calon Bebas M. Mohganan.

(1) mengenakan hukuman lebih berat terhadap pemberi dan penerima rasuah,
(11) gaji lebih baik untuk kakitangan awam,
(111) kurangkan birokrasi,
(1v) ketelusan dalam penajaan politik dan
(v) pendidikan yang memberi tumpuan kepada hakikat bahawa rasuah itu adalah satu dosa.
2. Megat Najmuddin berkata pemberian wang untuk belanja makan dan minyak bukan merupakan satu kesalahan kerana yang penting ialah niat di sebalik pemberian wang itu.

Beberapa Pemimpin Tinggi Umno Disiasat : Megat Najmuddin
Beberapa pemegang jawatan tinggi Umno kini disiasat ekoran aduan berlaku amalan politik wang dua tiga hari menjelang perhimpunan agung parti itu minggu lepas, kata Anggota Lembaga Disiplin Umno Tan Sri Megat Najmuddin Megat Khas.
"Saya tak ariflah kes-kes yang mana disiasat sekarang tapi saya dengar memang ada kes yang sedang disiasat.
"Sampai hari ini boleh tahan jugalah (bilangannya). Berkaitan dengan jawatan tinggi pun ada banyak," katanya kepada pemberita selepas membentangkan kertas kerja pada Sidang Kemuncak Anti Rasuah "Tiada Tolak Ansur Bagi Rasuah" anjuran Institut Strategi dan Kepimpinan Asia (ASLI) dan Transparency International Malaysia di sini, Selasa.
Beliau ditanya sama ada masih terdapat laporan politik wang yang disiasat oleh lembaga itu walaupun setelah perhimpunan agung Umno itu berakhir Sabtu lepas.
"Memang dalam perhimpunan agung, itulah masanya pun berkempen cara politik wang," kata Megat Najmuddin sambil menjelaskan beliau bagaimanapun tidak terbabit secara langsung dalam siasatan berkenaan kerana sebagai anggota lembaga mereka tidak boleh menjadi penyiasat, pendakwa dan juri sekaligus.
Ditanya sama ada kes berkenaan membabitkan juga Ketua Pemuda Umno Khairy Jamaluddin, beliau berkata sekiranya terdapat bukti sesiapapun akan dikenakan tindakan.
"Sesiapapun kita akan dakwa kalau ada bukti sahih yang teguh, tapi kalau bukti tak kuat, susah. Baik laporkan di Suruhanjaya Pencegahan Rasuah Malaysia atau Lembaga Disiplin," katanya.
Megat Najmuddin berkata pemberian wang untuk belanja makan dan minyak bukan merupakan satu kesalahan kerana yang penting ialah niat di sebalik pemberian wang itu.
"Kalau RM50 sekalipun tujuannya untuk membeli undi itu dikira rasuah politik dan politik wang. Jumlah tidak penting dan apa yang penting ialah niat," katanya.
Beliau menyambut baik kenyataan Timbalan Presiden Umno Tan Sri Muhyiddin Yassin yang mahu Lembaga Dispilin distruktur semula untuk diperkasakan.
"Elok sangatlah sebab kita pun tak ada jentera yang ramai untuk bekerja.
Negara kita agak besar, Umno juga besar dengan anggotanya lebih tiga juta orang, jadi kita perlu perkasakan," katanya.
Sebelum itu, semasa membentangkan kertas kerjanya, Megat Najmuddin mencadangkan lima langkah membanteras rasuah iaitu mengenakan hukuman lebih berat terhadap pemberi dan penerima rasuah, gaji lebih baik untuk kakitangan awam, kurangkan birokrasi, ketelusan dalam penajaan politik dan pendidikan yang memberi tumpuan kepada hakikat bahawa rasuah itu adalah satu dosa.

Several Umno leaders under probe: Megat Najmuddin
Several Umno leaders are being investigated for alleged involvement money politics in the run-up to the Umno General Assembly last week, a member of the party's Disciplinary Board Tan Sri Megat Najmuddin Megat Khas aid today.
He said the probe was carried out by officers of the board's investigation unit.
"I don't have the detail but I am made to understand that there are indeed investigations being carried out on a number of cases, including on those holding top posts," he said.
He was speaking to reporters after tabling a working paper at the "Anti Corruption Summit - Zero Tolerance for Corruption" organised by the Asian Strategy and Leadership Institute and Transparency International Malaysia here.
Megat Najmuddin said he was not directly involved in the investigation because board members cannot be the investigators, prosecutors and jurists at the same time.
He said action would be taken on anyone found to have breached party discipline.
"If we have proof we will call them to testify but we need strong evidence otherwise it will be difficult for us to act," he said.
He also said that there was nothing wrong with treating a person to a meal or paying for someone's fuel as long as there was no ulterior motives in doing so.
"The amount of bribe is not important. The measure of culpability lies in the intention. If you give RM50 to buy votes, it is political corruption or money politics," he said.
Megat Najmuddin also welcome Umno vice-president Tan Sri Muhyiddin Yassin's proposal to restructure the Umno Disciplinary Board to strengtnening it further.

PAUTAN: POLITIK WANG JADI BAHAN KAJIAN
KE MANA HALATUJU AKTIVITI BERBLOG KITA
Dalam melaksanakan tuntutan amar bil ma'ruf wan nahyu 'anil munkar (menyeru kepada yang ma'ruf dan mencegah dari yang munkar) , kita umat Islam dianjurkan untuk membuat tiga peringkat atau darjat tindakan.
Di peringkat paling lemah iman ialah sekadar membenci dalam hati apabila melihat maksiat dan munkar berleluasa di hadapan mata. Dalam sebuah hadith Ar rasul saw menyebut bahawa tiada iman walaupun sebesar biji sawi (? seberat atom) jika tidak sedikitpun timbul rasa benci dalam hati melihat kemunkaran.
Peringkat kedua apabila mengetahui atau melihat kemunkaran ialah dengan cuba merubah atau menghalangnya dengan lisan atau lidah jika seseorang itu mampu. Penggunaan lisan atau tulisan boleh jadi dalam bentuk kaset, ucapan, ceramah, nasihat, pidato, forum, dialog dan sebagainya. Penggunaan lisan dalam berdakwah mempunyai metodologi serta kaedah tertentu.
Peringkat ketiga dalam amar bil ma'aruf wan nahyu 'anil munkar ialah dengan penggunaan tangan yakni kekuasaan atau menghalang secara fizikal. Penggunaan kekuasaan terletak di bawah bidang politik dan pemerintahan. Tanpa kuasa dan pemerintahan, maksiat, murtad (riddah) dan munkar akan berleluasa serta bermahrajalela.
Walaupun terdapat individu Muslim atau bukan Muslim yang berhujah bahawa tiada paksaan dalam agama namun perlu diingat bahawa Ayat Al Quran tersebut merujuk kepada larangan memaksa orang memeluk Islam. Walau bagaimanapun setelah seseorang itu mengaku Muslim dengan ikrar lafaz dua kalimah syahadah, ia tertakluk kepada semua tuntutan sebagai seorang Muslim, setelah mengambil kira kemampuannya serta rintangan dan halangan yang ia hadapi.
Tiada sesiapa yang memaksa seseorang itu menceburi dalam bidang ketenteraan (kecuali program khidmat negara atau national service yang diwajibkan oleh negara). Tetapi apabila ia telah mendaftar sebagai seorang rekrut tentera, ia mahu tidak mahu mesti akur serta taat segala perintah dan larangan kem komanden seperti bangun pagi pada waktu tertentu, kawad, mengenakan uniform tentera, memakai but yang telah digilap sehingga berkilat, berambut pendek dan sebagainya. Ia tidak boleh lagi berhujah bahawa tiada siapa yang boleh memaksanya mentaati peraturan tentera atau ia bebas melakukan apa sahaja yang ia mahu.
Dalam membincangkan tajuk amar ma'ruf nahi munkar, izinkan saya menyentuh sebuah blog yang telah dilaporkan dikendalikan oleh seorang warga Klang dari Taman Sri Andalas dan bertugas di Affin Bank Jln Meru. Saya telah lebih dua puluh lima tahun menetap di Klang dan pernah tinggal serta bertugas di Tmn Sri Andalas.
Jika laporan tentang diri sebenar blogger PERAK BANGKIT itu sahih, saya berpendapat sahabat kita serta dan teman-temannya yang lain (admin atau webmaster blogspot berkenaan), telah tidak berlaku adil kepada dirinya serta Islam itu sendiri. Kenapa saya katakan begitu?
Dalam postingnya yang terkini bertajuk seperti di atas,
dari mana beliau memperolehi angka 65 % sedangkan
dalam blog beliau satu POLL telah dibuat dan sudahpun ditutup dengan 2926 pengunjung blog telah membuat undian. PAS memperolehi 62% sedangkan Barisan Nasional hanya mendapat 16%.
Jika PAS mendapat 62% ini juga bermakna NIZAR mendapat 62% bukan 35% seperti yang tertera dalam
tajuk post PERAK BANGKIT.
Di mana letaknya keadilan serta objektiviti pengendali blog ini?
Kedua penggunaan gambar lucah seorang wanita untuk menulis "kill nizar" adalah satu perbuatan yang tidak "manis" sebagai seorang yang mengaku Muslim. Mungkin masih boleh diterima atau dimaafkan jika blog ini diurustadbir oleh seorang yang belum ISLAM kerana ia masih tercari-cari kebenaran dan sedang mempelajari tentang Islam.
Kita akan dipertanggungjawbkan segala tindak tanduk kita, tutur kata, tulisan dan setiap yang kita lakukan dalam privasi kita atau di khalayak ramai.
Eloklah pengendali blog PERAK BANGKIT berbincang dengan kaunselor atau ustaz untuk tindakan selanjutnya. Tiada daya dan kekuatan melainkan dari ALlah. Tiada taufik dan hidayah melainkan dari Allah jua. Salam sejahtera. Berblog berpada-pada jangan sampai dikata go-blog; sebab pulut santan binasa, sebab tetikus iman binasa.
