Mahkamah Persekutuan Tangguh Penghakiman Isu Menteri Besar Perak
PUTRAJAYA, 5 Nov (Bernama) -- Soalan sama ada Datuk Seri Mohammad Nizar Jamaluddin mendapat semula jawatan sebagai Menteri Besar Perak masih belum terjawab apabila Mahkamah Persekutuan Khamis menangguhkan pengumuman penghakimannya berhubung isu itu ke suatu tarikh yang akan ditetapkan kelak.
Panel lima hakim berkenaan menangguhkan pengumuman keputusannya setelah mendengar penghujahan secara panjang lebar selama lebih enam jam daripada tiga pihak yang terlibat dalam isu perlembagaan Perak itu.
Para hakim yang menganggotai panel itu ialah Presiden Mahkamah Rayuan Tan Sri Alauddin Mohd Sheriff, Hakim Besar Malaya Tan Sri Ariffin Zakaria dan Hakim-hakim Datuk Zulkefli Ahmad Makinuddin, Datuk Wira Ghazali Mohd Yusof dan Datuk Abdull Hamid Embong.
Hari ini merupakan ruang terakhir bagi Mohammad Nizar mendapatkan perisytiharan mahkamah bahawa selama ini beliau adalah Menteri Besar Perak yang sah.
Krisis politik Perak bermula apabila dua anggota dewan undangan negeri daripada PKR -- Jamaluddin Mohd Radzi (Behrang) dan Mohd Osman Mohd Jailu (Changkat Jering) keluar daripada parti itu pada 30 Jan, diikuti tindakan anggota dewan undangan negeri daripada DAP Hee Yit Foong (Jelapang) meninggalkan parti itu empat hari kemudian.
Berikutan itu, Mohammad Nizar menghadap Sultan Azlan Shah pada 4 Feb bagi memohon baginda membubarkan dewan undangan negeri, tetapi permohonan beliau ditolak.
Pada 6 Feb, Zambry dilantik sebagai Menteri Besar Perak yang baru dan berikutan itu, Mohammad Nizar memfailkan permohonan kepada mahkamah bagi mendapatkan perisytiharan bahawa beliau adalah Menteri Besar Perak yang sah dan memohon perintah mahkamah menghalang Zambry daripada melakasanakan tugas sebagai Menteri Besar.
Pada 11 Mei, Mahkamah Tinggi Kuala Lumpur mengisytiharkan Mohammad Nizar sebagai Menteri Besar Perak yang sah dan memutuskan bahawa Sultan Perak Sultan Azlan Shah tidak mempunyai kuasa untuk memecat Mohammad Nizar daripada jawatannya kerana beliau (Mohamad Nizar) tidak memegang jawatan itu atas dasar perkenan Sultan.
Bagaimanapun, dalam penghakimannya ketika menolak keputusan Mahkamah Tinggi itu, Mahkamah Rayuan memutuskan bahawa Sultan Azlan Shah bertindak betul apabila baginda melantik Zambry sebagai Menteri Besar yang baru berpandukan Perkara 16(2) Undang-undang Tubuh Negeri Negeri Perak, setelah baginda berpuas hati bahawa Zambry mendapat sokongan majoriti di Dewan Undangan Negeri Perak.
Oleh kerana tidak berpuas hati dengan keputusan itu, Mohammad Nizar, yang hadir di mahkamah hari ini, mengemukakan rayuan.
Dalam hujahnya hari ini, peguam utama Sulaiman Abdullah yang mewakili Mohammad Nizar berkata Mahkamah Rayuan terkilaf dalam keputusannya kerana tidak mengguna pakai pendekatan yang tepat berhubung peruntukan yang terkadnung dalam Undang-undang Tubuh Negeri Perak.
Katanya Mohammad Nizar tidak boleh dipecat oleh Sultan dan satu-satunya cara yang boleh menyingkirkan beliau ialah melalui undi tidak percaya oleh anggota dewan undangan negeri.
"Undang-undang Tubuh Negeri Perak tidak memperuntukkan budi bicara bagi melantik dua orang memegang jawatan Menteri Besar," kata beliau.
Dalam hujah balasnya, Peguam Negara Abdul Gani Patail berkata Sultan Perak telah menimbang dengan teliti fakta serta keadaan yang wujud sebelum mengisytiharkan pada 5 Feb bahawa Barisan Nasional (BN)mempunyai majoriti di Dewan Undangan Negeri.
"Jelas sekali, Sultan Perak telah menunaikan tanggungjawab baginda dengan cara paling berhemah," kata beliau.
Sementara itu, dalam hujah beliau, peguam Datuk Cecil Abraham berkata tidak terdapat peruntukan secara tegas dalam Undang-undang Tubuh Negeri Perak yang menyebut bahawa kehilangan majoriti oleh seseorang Menteri Besar hanya boleh ditentukan oleh undi tidak percaya.
"Dalam kes ini, ia juga boleh ditentukan oleh Sultan setelah beliau memanggil menghadap 31 anggota dewan undangan negeri bagi memastikan siapa yang mendapat sokongan majoriti di dalam dewan," katanya.
Terdahlu, mahkamah itu menolak permohonan Mohammad Nizar agar rayuannya didengar oleh 11 hakim.
Bercakap kepada pemberita selepas prosiding itu, Mohammad Nizar berkata beliau kecewa dengan keputusan hari ini kerana kes berkenaan mempunyai kesan serius terhadap kepentingan awam.

Federal Court defers judgment on Perak crisis
PUTRAJAYA (Nov 5, 2009): Can Datuk Seri Mohammad Nizar Jamaluddin win back his post as the Perak mentri besar?
The question has yet to be answered because the Federal Court reserved its judgment today on the issue to a date to be fixed.
A panel of five judges deferred the decision after hearing lengthy submissions, which took more than six hours, from three parties involved in the Perak constitutional issue.
The judges who sat on the panel were Court of Appeal President Tan Sri Alauddin Mohd Sheriff, Chief Justice of Malaya Tan Sri Ariffin Zakaria and Justices Datuk Zulkefli Ahmad Makinuddin, Datuk Wira Ghazali Mohd Yusof and Datuk Abdull Hamid Embong.
Today was the final bid for Mohammad Nizar to get the court's declaration that he is at all material times the rightful mentri besar of Perak.
The Perak political crisis began when two PKR assemblymen -- Jamaluddin Mohd Radzi (Behrang) and Mohd Osman Mohd Jailu (Changkat Jering) -- resigned from PKR on Jan 30 and declared themselves as Barisan Nasional-friendly independents. DAP assemblyman Hee Yit Foong (Jelapang) followed in their footsteps four days later.
Following this, Mohammad Nizar had an audience with Sultan Azlan Shah on Feb 4 to request a dissolution of the state legislative assembly but the request was denied.
On Feb 6, Datuk Seri Dr Zambry Abdul Kadir was appointed as the new Perak mentri besar and following that, Mohammad Nizar filed an application to the court to get a declaration that he was the lawful mentri besar of Perak, and also an injunction to prevent Zambry from carrying out the mentri besar's duties.
On May 11, the Kuala Lumpur High Court declared Mohammad Nizar the legitimate mentri besar and ruled that the Sultan of Perak Sultan Azlan Shah could not dismiss Mohammad Nizar from his office because the mentri besar did not hold office at the pleasure of the Ruler.
The Court of Appeal, in its ruling overturning the High Court's decision, held that Sultan Azlan Shah was right in appointing Zambry the new mentri besar under Article 16(2) of the Perak Constitution, after being satisfied that Zambry had the command of the majority of the Perak state legislative assembly.
Dissatisfied with the ruling, Mohammad Nizar, who was present during the proceedings today, appealed against the decision.
Leading counsel Sulaiman Abdullah, for Mohammad Nizar, contended in his submission today the decision of the Appeal Court was erroneous as it did not apply the correct approach to the relevant provisions of the Perak Constitution.
He said Mohammad Nizar cannot be dismissed by the Sultan and the only way to do so was by a vote of no confidence by the members of the state legislative assembly.
"The Perak Constitution does not confer the discretion to appoint two persons to hold office of mentri besar," he said.
Attorney-General Abdul Gani Patail said in his reply the Sultan had carefully considered the facts and circumstances before declaring on Feb 5 that Barisan Nasional (BN) had the majority in the state assembly.
"The Sultan of Perak had clearly performed his function in the most honourable way," he said.
Counsel Datuk Cecil Abraham submitted that there was no express requirement in the Perak Constitution that a loss of majority support for the mentri besar could only be determined by a vote of no confidence.
"It can also be determined, in this case, by the Sultan meeting each of the 31 assemblymen to ascertain who had the majority in the House," he said.
Earlier in the proceedings, the court had rejected Mohammad Nizar's application for 11 judges to hear the appeal.
Met by the reporters afterwards, Mohammad Nizar said he was dissappointed with the decision as the case had serious implications on public interest.

Mahkamah Tinggi Putuskan Sultan Tidak Boleh Pecat Menteri Besar
KUALA LUMPUR, 18 Mei (Bernama) -- Sultan Perak Sultan Azlan Shah tidak boleh memecat Datuk Seri Mohammad Nizar Jamaluddin dari jawatannya kerana beliau (menteri besar) tidak memegang jawatan itu atas perkenan baginda.
Ini keputusan Hakim Mahkamah Tinggi Datuk Abdul Aziz Abdul Rahim bila beliau mengisytiharkan Mohammad Nizar sebagai Menteri Besar Perak yang sah pada 11 Mei.
Dalam penghakiman 78-muka yang dikeluarkan kepada media hari ini, Abdul Aziz berkata sebaik saja menteri besar dilantik, beliau dan majlis exconya bertanggungjawab kepada Dewan Undangan Negeri dan tiada siapa lain.
Beliau berkata ini menurut fasal (2), (5), (6) dan (7) Artikel 16 Undang-undang Tubuh Negeri Perak.
"Sebaik saja menteri besar dilantik, menteri besar mentadbir negeri menerusi Majlis Eksekutif dan menasihatkan Sultan mengenai hal ehwal negeri sebagaimana diperuntukkan di bawah Artikel 18 (1) Undang-undang Tubuh Negeri Perak.
Hakim Abdul Aziz berkata Sultan bertindak atas nasihat kecuali dalam perkara di mana Undang-undang Tubuh Negeri Perak memperuntukkan bahawa Baginda boleh bertindak atas budibicara baginda semata-mata.
Beliau berkata berdasarkan peruntukan dalam Artikel 16, ia mensyaratkan bahawa dewan undangan adalah pihak yang menentukan sama ada ia menaruh keyakinan terhadap menteri besar selaku ketua majlis eksekutif menerusi undi tidak percaya terhadap menteri besar.
"Saya berpendapat bahawa pemecatan menteri besar oleh Baginda atau oleh sesiapa lain tidak sekali-kali dipertimbangkan di bawah Artikel 16 (6) Undang-undang Tubuh Negeri Perak," kata beliau.
Beliau berkata fasal 7 Artikel 16 undang-undang tubuh itu memperuntukkan bahawa kecuali menteri besar, anggota-anggota lain Majlis Eksekutif memegang jawatan atas perkenan Sultan dan mereka (anggota eksekutif) boleh dipecat dari jawatan oleh Sultan yang bertindak atas nasihat menteri besar.
Abdul Aziz berkata Sultan Perak telah menemui dan menginterbiu tiga anggota dewan negeri yang menjadi anggota bebas dan seorang lagi anggota dewan yang sebelumnya keluar dari Barisan Nasional (BN) tetapi kemudian menyertai semula parti itu dan mereka memberitahu Sultan tentang sokongan mereka kepada BN secara sukarela tanpa dipaksa oleh mana-mana pihak.
Abdul Aziz, bagaimanapun berkata, walaupun menerusi pertanyaan Sultan, Baginda berpendapat Datuk Seri Dr Zambry Abdul Kadir mendapat sokongan majoriti anggota dewan undangan negeri, ini tidak bermakna Baginda boleh membuat keputusan bahawa Mohammad Nizar tidak lagi mendapat keyakinan majoriti dewan berkenaan.
Beliau berkata pendapat peribadi atau keputusan Sultan tidak relevan kepada maksud Artikel 16 (6) yang memperuntukkan bahawa "jika menteri besar tidak lagi mendapat keyakinan majoriti anggota dewan undangan, maka, kecuali atas permintaannya, Baginda membubarkan dewan, beliau dikehendaki mengemukakan peletakan jawatan majlis eksekutif".
Abdul Aziz mendengar prosiding semakan kehakiman yang dibawa oleh Mohammad Nizar, 52, memohon writ "quo warranto" dikeluarkan terhadap Zambry untuk memberi sebab atas asas apa atau kuasa apa beliau adalah menteri besar yang sah.
Abdul Aziz kemudian mengisytiharkan Mohammad Nizar sebagai menteri besar yang sah selepas memutuskan bahawa beliau (Nizar) tidak pernah melepaskan jawatan menteri besar oleh kerana beliau tidak kehilangan keyakinan majoriti dewan undangan negeri.
Mohammad Nizar, dilantik sebagai menteri besar pada 17 Mac tahun lepas selepas pakatan DAP-PKR-PAS memenangi 31 kerusi dalam plihan raya umum ke 12.
Kedua-dua pihak, bagaimanapun, mempunyai 28 kerusi masing-masing, selepas tiga anggota dewan dari pakatan itu keluar parti untuk menjadi anggota bebas dan yang keempat melompat semula dari PKR kepada Umno.
Sultan kemudian meminta Mohammad Nizar meletak jawatan menteri besar dan Zambry mengangkat sumpah selepas mengisytiharkan bahawa Barisan Nasional mempunyai majoriti di dewan undangan negeri.
Mahkamah Rayuan, pada 12 Mei, membenarkan perintah penangguhan keputusan itu kepada Zambry dan menetapkan Khamis ini untuk mendengar bersama permohonan Mohammad Nizar mengetepikan perintah penangguhan.
Dalam penghakimannya, Hakim Abdul Aziz juga berkata beliau tidak meragui bahawa Sultan mempunyai budibicara mutlak berhubung pelantikan menteri besar dan tidak memperkenan permintaan bagi pembubaran dewan undangan negeri.
"Saya tidak pernah meragui tentang pelaksanaan prerogatif diraja untuk melantik seorang menteri besar mengikut Artikel 16 (2) Undang-undang Tubuh Negeri Perak semata-mata berdasarkan pendapat peribadi Baginda.
"Dan bahawa Baginda boleh memilih apa carapun bagi memuaskan hati dan membuat keputusan sewajarnya tentang siapa yang mendapat keyakinan majoriti dewan undangan negeri hingga beliau boleh dilantik sebagai menteri besar untuk memimpin majlis eksekutif," katanya.
Abdul Aziz bagaimanapun berkata perkara yang sama tidak boleh dilakukan berhubung Artikel 16 (6) dalam memutuskan sama ada menteri besar tidak lagi mendapat keyakinan majoriti anggota dewan undangan.

Sultan Cannot Dismiss Menteri Besar From Office, High Court Rules
KUALA LUMPUR, May 18 (Bernama) -- Sultan of Perak Sultan Azlan Shah cannot dismiss Datuk Seri Mohammad Nizar Jamaluddin from his office because the latter (menteri besar) does not hold office at the pleasure of the ruler.
This is the ruling of High Court Judge Datuk Abdul Aziz Abdul Rahim when he declared Mohammad Nizar as the legitimate Menteri Besar of Perak on May 11.
In his 78-page judgment released to the media Monday, Abdul Aziz said once a menteri besar was appointed, he and his executive council were answerable to the State Legislative Assembly and to no one else.
He said this was so under clauses (2), (5), (6) and (7) of Article 16 of the Perak State Constitution.
"Once a menteri besar is appointed, the menteri besar governs the state through the Executive Council and advises the Sultan on the affairs of the state provided under Article 18 (1) of the Perak State Constitution.
Justice Abdul Aziz said the Sultan would then act upon the advice except in matters where the Perak State Constitution provides that his Royal Highness may act in his own absolute discretion.
He said based on the provisions in Article 16, the said Article requires that the legislative assembly be the one to determine whether it has confidence in the menteri besar as the head of the executive council through a vote of no confidence against the menteri besar.
"It is my opinion that the dismissal of the menteri besar by His Royal Highness or by any one else is never contemplated under Article 16 (6) of the Perak State Constitution," he said.
He said clause 7 of Article 16 of the Perak State Constitution provided that except for the menteri besar, other members of the Executive Council held office at the Sultan's pleasure and they (the executive members) may be removed from office by the Sultan acting on the menteri besar's advice.
Abdul Aziz said the Sultan of Perak had met and interviewed the three state assemblymen who turned independent and another assemblyman who earlier quit Barisan Nasional (BN) but rejoined and they had informed the ruler that they had pledged their support for BN voluntarily without any coercion from any party.
Abdul Aziz, however, said although through the Sultan's enquiries, His Royal Highness had judged that Datuk Seri Dr Zambry Abdul Kadir had the support of the majority of the members of the state legislative assembly, it did not mean that His Royal Highness could form an opinion that Mohammad Nizar had ceased to command the confidence of the majority of the assembly.
He said the Sultan's personal opinion or judgment was irrelevant to the construction of Article 16 (6) which provided that "if the menteri besar ceases to command the confidence of the majority of the members of the legislative assembly, then, unless at his request, His Royal Highness dissolves the assembly, he shall tender the resignation of the executive council".
Abdul Aziz heard the judicial review proceedings initiated by Mohammad Nizar, 52, seeking for a writ of "quo warranto" to be issued against Zambry to show cause on what basis or authority that he (Zambry) was the rightful menteri besar. He then declared Mohammad Nizar as the rightful menteri besar after ruling that he (Nizar) had not vacated the office of menteri besar since he had not lost the confidence of the majority of the state legislative assembly.
Mohammad Nizar, was appointed menteri besar on March 17 last year after the DAP-PKR-PAS alliance won 31 seats in the 12th general election.
Both sides, however, have 28 seats each in the 59-seat assembly after three assemblymen from the alliance quit their parties to become independents and the fourth jumped back from PKR to Umno.
Sultan Azlan Shah then asked Mohammad Nizar to step down as menteri besar and swore in Zambry after declaring that Barisan Nasional had the majority in the state legislative assembly.
The Court of Appeal, on May 12, granted a stay order to Zambry and has fixed this Thursday for hearing together with Mohammad Nizar's application to set aside the stay order.
In his written judgment, Justice Abdul Aziz also said he had no doubt that the Sultan has absolute discretion with regard to the appointment of menteri besar and the withholding of consent to a request for the dissolution of the state legislative assembly.
"I never had any doubt that the exercise of royal prerogative to appoint a menteri besar pursuant to Article 16 (2) of the Perak State Constitution is solely based on personal judgment of His Royal Highness.
"And that His Royal Highness may resort to any means in order to satisfy himself and accordingly to form his judgment as to whom who is likely to command the confidence of the majority of the state legislative assembly that he can be appointed as the menteri besar to lead the executive council," he said.
Abdul Aziz however said the same thing cannot be done with regard to Article 16 (6) in deciding whether the menteri besar ceases to command the confidence of the majority of the members of the legislative assembly.

Dan sekiranya Nizar berjaya disingkirkan melalui undi tidak percaya, ini bermakna Zambry kena mengangkat sumpah semula kerana sumpah yang lama itu tidak sah hukumnya. Mana mungkin seseorang Menteri Besar itu dikenakan undi tidak percaya selepas Menteri Besar baru dilantik, melainkan dilantik Menteri Besar baru sesudah Menteri Besar lama dijatuhkan. Sumpah yang lama itu tidak laku, tidak sah dan haram."

MINGGU lepas suasana politik negara kita agak aneh. Dalam suasana tegang kerana penyalahgunaan pasukan keselamatan untuk menjaga 'keselamatan' kuasa politik Umno/BN, tiba-tiba 13 tahanan ISA dibebaskan.
Saya amat kesal sekali dengan kejadian pencerobohan oleh satu kumpulan yang dikatakan 'pasukan keselamatan' ke atas Dun Perak, sedangkan di luar pejabat SUK Perak, sejumlah polis sedang menyekat kebebasan rakyat untuk bergerak, berhimpun dan berpendirian politik.
Saya rasa ini kali pertama dalam sejarah negara kita sidang Dun dicemari oleh penceroboh yang bersenjata. Hal ini tidak akan berlaku sekiranya BN tidak melakukan rampasan kuasa pada Februari 2009 lalu. Rampasan kuasa ini walaupun kelihatan seperti mendapat restu istana, tetapi rakyat telah membuat penghakiman bahawa ia adalah sesuatu yang tidak baik.
Kerana pendirian tegas rakyat di Bukit Gantang dan Bukit Selambau yang menolak politik ugut, culik, paksa dan rasuah yang diamalkan oleh Umno/BN, maka ketika bekas Timbalan Ketua Menteri Pulau Pinang, Mohd Fairuz Khairuddin meletakkan jawatan sebagai Adun Penanti, pemimpin BN mempertikaikannya. Bahkan, Najib Razak awal-awal sudah membayangkan kemungkinan BN tidak bertanding. Sebabnya hanya satu... takut kalah lagi.
Dalam keadaan politik ketakutan ini, nampaknya M Manoharan, Adun Kota Alam Shah lebih licik apabila beliau membuat ugutan untuk meletakkan jawatan jika tidak dibebaskan daripada tahanan ISA. Kerana terlalu takutkan pilihan raya kecil, Najib Razak tidak ada pilihan melain membebaskan Manoharan. Dua belas yang lain mendapat "durian runtuh" daripada pembebasan ini. Cerita tentang Penanti dan ISA ini menyinggung hidup saya kerana saya pernah ditahan ISA dan pernah juga bertanding di Parlimen Permatang Pauh yang Dun Penanti terletak di dalamnya.
Kerana sindrom takutkan pilihan raya atau lebih tepat lagi takutkan penghakiman rakyat, BN melakukan taktik kotor untuk mendapatkan kuasa. Dulu mereka merampas kerajaan Perak, baru-baru ini mereka melakukan rampasan jawatan Speaker Dun Perak secara tidak berperlembagaan. Keadaan sudah menjadi kecoh kerana Dun Perak tidak dapat bersidang dengan baik dan sempurna, bahkan dianggap tidak sah.
Umno/BN terpaksa mengadakan sidang tegesa-gesa ini untuk mengelakkan Dun terbubar dengan sendiri kerana sudah hampir enam bulan tidak bersidang. Dan mereka berusaha dengan cara yang jahat untuk menlantik Speaker haram, R Ganesan dengan tujuan membolehkan mereka mengemukakan undi tidak percaya kepada Datuk Seri Nizar Jamaluddin.
Telahan mereka memang tepat kerana selepas sidang tersebut, mahkamah telah mengisytiharkan Nizar adalah Menteri Besar yang sah. Maknanya Zambry Abdul Kadir adalah Menteri Besar haram!
Kini Umno tidak ada jalan lain kecuali memperalatkan mahkamah untuk menjatuhkan Nizar. Masalahnya kedudukan Speaker Dun masih tidak jelas. Jika Dun brsidang juga, ia akan menimbulkan keadaan politik yang lebih kecoh terutama sekiranya undi tidak percaya dibuat. Bukan soal Speaker, tetapi tentang kedudukan Zambry Abdul Kadir.
Jika BN membuat usul undi tidak percaya kepada Nizar, maka dengan sendirinya mereka memperakui bahawa tindakan mereka merampas kuasa dan melantik Zambry sebagai Menteri Besar adalah tidak sah dan haram di sisi undang-undang. Kerja buat Zambry sebagai Menteri Besar semenjak 6 Februari 2009 adalah haram juga. Gaji yang diambil oleh Zambry juga haram. Di mana maruah dan air muka Zambry sebagai Menteri Besar haram dalam isu ini. Ia bukan soal pandangan rakyat atau pendirian mahkamah, tetapi pengakuan Umno/BN sendiri yang akan dibuat melalui undi tidak percaya itu.
Undi tidak percaya hanya dibuat kepada Menteri Besar yang sah. Tidak pernah berlaku undi tidak percaya dikemukakan kepada bekas Menteri Besar atau kepada orang lain yang bukan Menteri Besar. Ini bermakna usul undi tidak percaya jika berlaku adalah satu pengiktirafan bahawa Nizar adalah Menteri Besar yang sebenar.
Dan sekiranya Nizar berjaya disingkirkan melalui undi tidak percaya, ini bermakna Zambry kena mengangkat sumpah semula kerana sumpah yang lama itu tidak sah hukumnya. Mana mungkin seseorang Menteri Besar itu dikenakan undi tidak percaya selepas Menteri Besar baru dilantik, melainkan dilantik Menteri Besar baru sesudah Menteri Besar lama dijatuhkan. Sumpah yang lama itu tidak laku, tidak sah dan haram. Walaupun Mahkamah Rayuan membenarkan permohonan Zambry untuk menangguhkan keputusan Mahkamah Tinggi, namun kedudukan Zambry tetap haram.
Sekiranya Zambry memilih untuk menjatuhkan Nizar melalui undi tidak percaya dan dia mengangkat sumpah semula, ini bermakna Zambry memilih untuk memalukan Tuanku Sultan Perak. Baginda sudah tentu berasa malu kerana tindakan baginda memanggil Zambry mengangkat sumpah dahulu dianggap tidak sah, sedangkan baginda adalah bekas Ketua Hakim Negara.
Proses mengenakan undi tidak percaya ini dalam apa keadaan pun akan memalukan Sultan Perak. Pertama, baginda akan tercemar kerana telah melantik Zambry secara haram; kedua, baginda mendapat malu kerana mahkamah telah memutuskan Nizar yang dipecat oleh baginda sebagai Menteri Besar yang sah; dan ketiga baginda akan dimalukan lagi apabila Dun tidak mengiktiraf keputusan baginda dengan membuat usul tidak percaya kepada Nizar.
Dalam apa keadaan pun, baginda akan tercemar kerana permainan politik kotor BN yang didalangi sendiri oleh Najib Razak.
Tuanku Sultan Perak hanya ada satu pilihan untuk membersihkan nama baginda dan memulihkan keyakinan rakyat kepada istana, sekali gus menamatkan krisis politik ini iaitu dengan memperkenankan permohonan membubarkan Dun.
Semua pihak sudah sepakat supaya Dun dibubarkan. Pemimpin MCA dan Gerakan sudah membuat pendirian, Tengku Razaliegh juga telah memberi pandangan. Suhakam dan pengamal undang-undang juga mahukan Dun dibubarkan sebagai jalan keluar. Yang tidak mahu kerana percaya BN akan kalah hanyalah Tun Dr Mahathir.
Pemangku Sultan Perak sudah memberitahu bahawa istana berada di atas politik. Maknanya baginda tidak memihak. Sebagai ketua negeri, sudah tentu baginda mengutamakan rakyat Perak. BN berkata mereka mendahulukan rakyat juga dan inilah masa untuk membuktikannya. Jika Sultan Perak mengikut pendapat Mahathir yang tidak mahu pilihan raya, baginda akan dilihat memihak. Tetapi jika baginda membubarkan Dun semua rakyat akan berpuas hati kerana hak memilihkan kerajaan dikembalikan kepada rakyat, bukannya dengan membeli wakil rakyat.

Mahkamah Rayuan sementara itu terlalu sibuk sehinggalah 18hb Mei 2009 untuk mendengar kes Nizar (persepsi penulis). Mahkamah Rayuan hanya memerlukan sehari untuk permohonan mendengar kes Zambry dan membuat keputusan. Mungkin dalam kes Nizar mahkamah rayuan perlu masa untuk merujuk kesnya ke peringkat antarabangsa ( Queen Counsel agaknya) atau lebih tinggi dari itu.

Mahkamah dengar rayuan Nizar 18 Mei
KUALA LUMPUR,13 Mei (Hrkh) - Mahkamah Rayuan hari ini menetapkan 18 Mei ini untuk mendengar rayuan Dato' Seri Mohammad Nizar Jamaluddin bagi mengetepikan keputusan Mahkamah Rayuan semalam yang membenarkan penangguhan pelaksanaan keputusan Mahkamah Tinggi.
Tarikh itu ditetapkan selepas Nizar memfailkan notis usul itu di pejabat Pendaftar Mahkamah Rayuan hari ini melalui firma guaman Tetuan Leong & Tan.
Kelmarin Mahkamah Tinggi memutuskan bahawa Nizar ialah Menteri Besar Perak yang sah.
Turut disertakan bersama notis usul itu ialah sijil supaya kes itu disegerakan.
Bagaimanapun Hakim Mahkamah Rayuan, Dato' Ramly Ali membenarkan Dato' Seri Dr. Zamry Abdul Kadir kekal sebagai Menteri Besar Perak sehingga Mahkamah Rayuan menyelesaikan kes rayuannya terhadap keputusan Mahkamah Tinggi semalam yang mengisytiharkan Nizar sebagai Menteri Besar Perak yang sah.
Dalam afidavit sokongannya, Nizar berkata keputusan Mahkamah Rayuan semalam untuk memberikan perintah penggantungan itu kepada Zambry adalah salah dan beliau (Nizar) mengemukakan permohonan untuk membetulkan perkara itu.
Nizar berkata Mahkamah Tinggi telah membuat takrif yang betul terhadap Perkara 16 (6) Undang-Undang Tubuh Negeri Perak.
Beliau berkata sekiranya perintah pelaksanaan itu diberikan ia akan merampas haknya serta membuat keputusan Mahkamah Tinggi mengisytiharkannya menteri besar Perak sebagai sia-sia.
Menurutnya perintah yang diperoleh Zambry itu akan mengganggu pelaksanaan secara lancar dan baik pentadbiran kerajaan negeri Perak selaras dengan peruntukan Undang-Undang Tubuh Negeri Perak.
Nizar juga berkata perintah berkenaan akan mengelirukan rakyat negeri itu mengenai siapakah menteri besar yang sah serta menjadikan keadaan politik lebih tegang dan krisis perlembagaan lebih mendalam.

Court of Appeal to hear Nizar's application on Monday

PUTRAJAYA (May 13, 2009) : The Court of Appeal will hear on Monday Datuk Seri Mohammad Nizar Jamaluddin's application to set aside a stay of execution order on the High Court decision declaring him the rightful mentri besar of Perak.
Nizar's application was filed at the Court of Appeal registry at 2.20pm today through his lawyers Messrs Leong and Tan.
He is seeking to set aside the stay of execution order granted to Datuk Dr Zambry Abdul Kadir by Court of Appeal judge Datuk Ramli Ali yesterday. Alternatively, Nizar wants the court to vary the stay order to include conditional terms, which are deemed fit and proper.
In his application, Nizar said a stay of execution order cannot be granted for declatory orders. He said special circumstances are in favour of him, for the court not to grant the stay order.
He also said there is no prejudice against Zambry if the stay order is not granted or not continued further.
In a supporting affidavit filed with the notice of motion, he said the Court of Appeal judge has erred in granting the stay order and the application was filed to correct the matter.
Nizar said that before May 11, 2009, he had never applied for any stay of execution order against Zambry as Nizar did not want to cause political instability and constitutional crisis in Perak to become even worse.
He said he waited for the High Court proceedings as usual and intended to respect the process and the decision of the High Court.
He said if the stay was granted it will;
> take away his rights and the High Court order which he had been waiting will become ineffective;
> disrupt and prevent the administration of Perak to be executed smoothly and in accordance with law;
> substantively, Zambry will carry out his responsibility, duties and functions illegally
> confuse the people as to who is the Mentri Besar as the High Court judgement stated that he is the MB
> confuse the Perak state government's officers and third parties as to the real status of the MB and his Exco members
> could cause political instabililty and constitutional crisis to become deeper
> cause undesirable emotions among the people as Nizar had been informed that the people had accepted the High Court decision well.
He added that the MB's post is to serve the people and that the post is "an office of trust", which means the MB is holding the trust for the people.
Nizar said the post does not belong to anyone personally and that Zambry or himself do not have personal rights on the post.
He said there is no prejudice towards Zambry if the stay is not given but if it was given it will be prejudice towards him.
Meanwhile, in Ipoh, state DAP chairman Datuk Ngeh Koo Ham said Zambry must not continue to present himself as the Mentri Besar because it is a contempt of court as the High Court had ruled that Mohammad Nizar is the rightful Mentri Besar.
In a statement, he said that although the Court of Appeal had granted Zambry a stay of execution, "it is without a doubt that until the High Court judgment is reversed by the Court of Appeal, Zambry remains an illegally appointed Mentri Besar".
He said a stay order merely gave one an opportunity to get the opinion of a higher court before the judgment of the lower court can be enforced.
Ngeh, who is a practising lawyer, said Zambry should not and cannot exercise the powers and the privileges of Mentri Besar, including going back to occupy the office of the Mentri Besar.
"Zambry also has no power to reinstate the state secretary and state legal adviser, who were suspended by the Pakatan Rakyat state government through its exco meeting on the night of May 11 (before the stay order was granted to Zambry)," he said.
Ngeh also said the statement by Chief Secretary to the Government Tan Sri Mohd Sidek Hassan that action cannot be taken by the state government against the state secretary and the state legal adviser was legally flawed.
"The state secretary and the state legal adviser are federal officers appointed by the Public Service Commission and the Judicial and Legal Service Commission, respectively, but when they are seconded to the state government, it has the authority over them as their employer," he said.
"Therefore, when they acted against the interest of the state government, they can be suspended from their duties pending formal complaints being lodged against them with the Public Service Commission and the Judicial and Legal Service Commission, respectively, and be dealt with under the Public Officers (Conduct and Discipline) Regulations 1993.
"Any other interpretation will mean that federal officers can lord over the state governments with impunity. Therefore, the Pakatan Rakyat state government has acted within what is permitted in law."
Zambry's adviser and Gerakan deputy president Datuk Chang Ko Youn argued that when the Court of Appeal granted the stay "everything must remain status quo".
He said the reason for the Court of Appeal to grant the stay order was the state could not afford to have a vaccum and that there must be someone to head the government.
"The situation will remain status quo until the Court of Appeal decides whether to uphold the decision of the High Court or not," he said.
Barisan Nasional state speaker Datuk R. Ganesan said the removal of PR Speaker V. Sivakumar at the state assembly sitting last Thursday was "undoubtedly legal".
He said that when a motion was moved against the Speaker, he must not decide on the motion because he was the interested party and it was against the natural rule of justice.
Since Sivakumar could not rule on the motion, it was "natural" for Deputy Speaker Hee Yit Foong to replace him, "which had been done correctly and (with) the support of 31 assemblymen, they elected me (as the Speaker)".
"How could they say I am not the rightful Speaker? It was legally done and I have no doubt about it."
Ganesan also said he did not mention he was going to call for an emergency sitting of the assembly.
"We respect the decision of the High Court and I will leave it to the BN leadership to proceed with whatever action necessary," he said.

Zambry diingatkan tidak tambah kekalutan di Perak
Dato' Dr Zambry Abd Kadir diminta supaya tidak menambahkan lagi kebuntuan dan kekalutan yang dihadapi rakyat Perak.
Ketua Penerangan PAS Pusat, Dato' Mahfuz Omar dalam satu kenyataan kepada Harakahdaily menegaskan keputusan Mahkamah Tinggi Kuala Lumpur masih sah dan tidak seharusnya Zambry bertindak berlawanan dengan keputusan tersebut.
"Mahkamah Rayuan hanya menangguhkan keputusan Mahkamah Tinggi bukannya membatalkan.
"Kerana itu Zambry harus ingat bahawa dia bukanlah Menteri Besar yang sah dan untuk itu beliau tidak boleh bertindak di luar dari apa yang diputuskan oleh Mahkamah Tinggi," tegas Mahfuz.
Zambry, tegas Mahfuz dalam keadaan sekarang tidak boleh meluluskan sebarang projek dan hanya boleh mempengerusikan mesyuarat exco untuk berbincang soal pentadbiran semata-mata.
Mahfuz dalam masa yang sama berpendapat Mahkamah Rayuan sepatutnya memberikan syarat tertentu kepada Zambry bila memutuskan untuk menerima permohonan menangguhkan keputusan Mahkamah Tinggi Kuala Lumpur.
Antara syarat yang boleh diberikan tegas Mahfuz, Zambry tidak dibenarkan melakukan apa-apa yang bertentangan dengan keputusan yang telah dibuat oleh Mahkamah Tinggi Kuala Lumpur.
Beliau menegaskan, PAS bimbang jika syarat seperti itu tidak diberikan, Zambry akan membuat keputusan yang boleh memberi kesan kepada kewangan Perak.
Semalam Mahkamah Rayuan membenarkan permohonan Zambry untuk menangguhkan keputusan Mahkamah Tinggi Kuala Lumpur 11 Mei lepas yang mengisytiharkan Dato' Seri Mohammad Nizar Jamaluddin sebagai menteri besar Perak yang sah.
Penangguhan keputusan mahkamah itu diberikan sementara menunggu selesai rayuan yang dikemukakan oleh Zambry berhubung perkara tersebut.

Nizar was declared the rightful mentri besar by the Kuala Lumpur High Court on Monday.
On Monday, High Court (Appellate and Special Powers) judge Justice Abdul Aziz Abdul Rahim had granted a declaratory relief to Nizar that he is still and was mentri besar at all material times.
The court, which issued a declaratory relief that Datuk Seri Dr Zambry Abd Kadir had no right to occupy the office of Perak Mentri Besar, also ordered him to show cause and give information under what policy, power or authority he allegedly held office and exercised the responsibilities, functions and duties as mentri besar.

IPOH, May 12 - Perak continues to be in a state of confusion as Pakatan Rakyat's (PR) Datuk Seri Nizar Jamaluddin maintained today he was still the legitimate mentri besar despite a Court of Appeal decision this morning which granted a stay on a High Court declaration yesterday.
While stating that the stay of execution raised more questions than answers, Nizar suggested that the only logical conclusion was that he was still mentri besar.
Barisan Nasional's (BN) Datuk Seri Zambry Abd Kadir had earlier claimed he was now the rightful MB after the court had granted him a stay pending his appeal on the decision by the High Court yesterday that Nizar was and is the MB.
But at a press conference this evening with two lawyers, Nizar's counsel Leong Cheok Keng and one of his state executive councillors Thomas Su, Nizar insisted that despite the stay, his government was still legitimate.
Su had said that while PR accepted the decision of the Court of Appeal, they were unsure as to what it really meant.
But Nizar reasoned that as the stay did not mean that Zambry had been affirmed as MB nor was it possible for there to be no MB, the only option left was that he remained the rightful mentri besar.
"Since I was sworn in on March 12, 2008, I have been the mentri besar until now," Nizar said.
"The High Court ruling was not an order to act which can be stopped by staying it. It is not like paying damages where you can halt the payment until a decision has been made," explained Leong.
"This is a declaration that Nizar has been the legitimate MB all this while. How can you temporarily vacate him from office?" he added.
Leong also said that he has never come across a stay of execution over a declaration, something which High Court Judge Datuk Abdul Aziz Abdul Rahim had also expressed after delivering his verdict yesterday.
"It is impossible not to have a mentri besar at any point of time. There cannot be a gap," Nizar added.
Su insisted that Zambry could not be MB as the stay did not overturn the High Court's ruling, and hence, this meant that Nizar was still the mentri besar.

KUALA LUMPUR: (May 12, 2009) : Are all documents signed by Datuk Dr Zambry Abdul Kadir during the last two months when BN was governing Perak legal?
Raising the poser yesterday was Perak Chinese Chamber of Commerce and Industry president Datuk Lim Kok Cheong in the light of the High Court declarion yesterday that Datuk Seri Mohammad Nizar Jamaluddin is Perak's rightful Mentri Besar.
"Zambry can appeal the court decision but while pending a decision on the appeal, can Nizar and his exco members perform their official duties?" he asked.
He said questions such as this will crop up which may lead to more court cases, which cannot be resolved by dissolving the state assembly, he said.
Speaking to Sin Chew Daily after the High Court in Kuala Lumpur ruled yesterday that Datuk Seri Mohammad Nizar Jamaluddin is the rightful Perak Mentri Besar, Lim said Pakatan Rakyat (PR) and Barisan Nasional (BN) should sit down to talk about how they can cooperate to improve the state's economy.
Lim, who is also the deputy president of the Associated Chinese Chambers of Commerce and Industry, said since Prime Minister Datuk Seri Najib Abdul Razak has stated BN is willing to cooperate with PR, the two sides should leave their political tussle to the next general election and focus their energy and attention on improving the state's economy now.

Zambry back as MB

PUTRAJAYA (MAy 12, 2009) : Datuk Seri Mohammad Nizar Jamaluddin clocked in as the Mentri Besar of Perak this morning following a High Court order declaring him the rightful chief executive of the state, but by afternoon, the seat went back to Datuk Dr Zambry Abdul Kadir.
This is because the Court of Appeal today granted an urgent application by Barisan Nasional mentri besar Zambry for a stay of execution of the High Court order made on Monday afternoon that Pakatan Rakyat's Mohammad Nizar is the rightful Mentri Besar, pending an appeal of the decision.
This means Nizar's position is now back to his position before 3.30pm on Monday, when the High Court decision was delivered.
In granting the stay of High Court judge Datuk Abdul Aziz Abdul Rahim's order, Justice Datuk Ramli Ali said the case is unique as it does not only involve Nizar and Zambry alone, but the whole state.
He said the court has the jurisdiction to grant a stay order on declaratory orders.
"The court is satisfied that there are special circumstances in this case. Stay is granted," said Ramli, adding that the court will fix an early date to hear Zambry's appeal.
After the decision, Nizar's lawyer, Sulaiman Abdullah, asked whether the judge will be imposing any terms (conditions) but the judge said he would not.
Lawyer Ranjit Singh, who also represents Nizar, said they will file an application to set aside the stay order, before a panel of three judges of Court of Appeal, on an urgency basis.
Earlier, Sulaiman said "the best solution for this problem" is to fix an early date to hear the appeal.
He said Zambry should have gone back to the High Court for a stay order as in earlier attempts in the case, the Federal Court had ordered the case to go back to the High Court.
(On Monday, the High Court judge had asked the lawyers to put in written application for him to hear.)
Zambry's lawyer Datuk Cecil Abraham earlier told the court that if a stay is not granted, the "status quo" will be changed pending the appeal. He said if the Court of Appeal does not grant a stay, a dissolution can take place for fresh election.
Attorney-General Tan Sri Abdul Gani Patail, who is an intervenor in the case, said if Nizar is asking for a dissolution of the assembly now, it has to be due to loss of confidence of the majority.
"If he goes to back to the State Legislative Assembly, what will happen? Thirty Barisan Nasional supporters will say we don't support you," said Gani, adding that Nizar will be asking for a dissolution. "Either way, If the Sultan of Perak says 'No', he has to go back to the Assembly."
Gani said the matter has to be settled "once and for all" and that the state cannot have changes "like flips of a coin" every few months.
> Zambry's response:
Zambry told reporters at the Umno headquarters in Ipoh he would continue his job as the Mentri Besar until the legal process is completed.
"It may look messy for the people but it was Mohammad Nizar who challenged my status as the MB. I hope the people can understand as I understand the public views but this is a legal process we must respect."
Zambry said BN has abided by the law and vacated the MB's office once the High Court made its decision,
"For me (after the High Court's decision on Monday), I did not go to the office or seek an audience with the Ruler although we (including the executive councillors) were invited to the palace to attend the investiture ceremony in Kuala Kangsar and I had ordered all to leave the office."
Asked for his opinion on Mohammad Nizar's official request to seek an audience with the Ruler, which was sent this morning, Zambry said when the Court decides, whatever happened before that was no longer valid.
On the status of the state assembly sitting on May 7, which was branded by Perak DAP chairman Datuk Ngeh Koo Ham as illegal, Zambry said the opposition could call him the illegitimate MB but the right to call for a sitting lies with the Ruler, not with the Mentri Besar.
Asked if BN will call for an emergency sitting to pass a motion of no-confidence against Mohammad Nizar, Zambry said it was premature to talk about this.
Zambry has also lifted Nizar's order to suspend State Secretary Datuk Abdul Rahman Hashim and state legal adviser Datuk Ahmad Kamal Shahid.
> Nizar's response:
"Whatever court action, we need to sincerely stop the impasse. The only remedial action that can stop this impasse is a dissolution of the assembly."
Mohammad Nizar reached his office with his executive councillors, which was heavily guarded by the Federal Reserved Unit at 7.30am, and left 20 minutes later for Kuala Kangsar to attend the investiture ceremony at the palace.
He returned to the state secretariat around 1.30pm and vacated his office at 2.35pm.
Earlier, Ngeh, who represented Mohammad Nizar to hold a press conference at the MB office, said while the legal process can go up to the Federal Court, such a prolonged impasse will not do any good for the people and the best solution is to hold fresh elections.

So, what does the 'stay of execution' order mean when the Court did not fix the date for hearing of Zambry's appeal over yesterday's High Court ruling?
Or rather, what doesn't the court order mean in terms of implications?
* It doesn't mean that the Court of Appeal has overturned the High Court's ruling yesterday that Nizar is, and was, the rightful MB at all material time.
* It doesn't mean that Nizar has exhausted his options, including his right to appeal to a three-man bench of the Court of Appeal to set aside this court’s stay order.
* It doesn't mean that the Sultan cannot consent to Nizar's request to dissolve the state assembly to call for fresh state-wide election.
* It doesn't mean that the decision of the Court of Appeal is final recourse for Nizar and/or Zambry. The Federal Court awaits.
On the other hand, the decision made by the Court of Appeal may create another miscarriage of natural justice:
1. The stay order will allow the “person found by the High Court to be the usurper" of authority to continue his office.
2. The stay order will enable Zambry to initiate a motion of no-confidence against Nizar and the court can later say the case is academic as Nizar is no longer mentri besar.

Krisis Perak: Jawatan MB Perak Kembali Kepada Zambry
IPOH, 12 Mei (Bernama) -- Krisis politik Perak menjadi bertambah rumit Selasa apabila Mahkamah Rayuan di Putrajaya membenarkan penangguhan pelaksanaan keputusan Mahkamah Tinggi Kuala Lumpur semalam yang mengisytiharkan Datuk Seri Mohammad Nizar Jamaluddin sebagai Menteri Besar Perak yang sah.
Dengan keputusan itu jawatan Menteri Besar Perak kini kembali kepada Datuk Seri Dr Zambry Abdul Kadir sementara menunggu perbicaraan rayuannya terhadap keputusan Mahkamah Tinggi itu.
Ia sekaligus memendekkan tempoh perkhidmatan Mohammad Nizar sebagai Menteri Besar hari ini, yang hanya sempat mempengerusikan satu mesyuarat Exco awal pagi ini di Pajabat PAS Negeri di sini, dan menghadiri istiadat pengurniaan darjah kebesaran negeri sempena Hari Keputeraan Sultan Perak Sultan Azlan Shah di Istana Iskandariah, Bukit Chandan, Kuala Kangsar pagi ini.
Jika semalam Zambry telah mengosongkan pejabatnya sebaik mengetahui keputusan Mahkamah Tinggi Kuala Lumpur, hari ini beliau meminta Mohammad Nizar pula mengambil langkah serupa.
Bercakap kepada pemberita di sini, Zambry berkata beliau akan meneruskan tugas sebagai Menteri Besar seperti biasa berikutan keputusan Mahkamah Rayuan hari ini dan meminta Mohammad Nizar menghormati proses perundangan.
Zambry berkata beliau akan terus bertugas sebagai Menteri Besar sehingga selesai proses perundangan di Mahkamah Rayuan dan kemungkinan juga hingga ke Mahkamah Persekutuan.
Hakim Mahkamah Rayuan Datuk Ramly Ali, yang membenarkan permohonan Zambry bagi penangguhan pelaksanaan keputusan Mahkamah Tinggi itu hari ini, berkata mahkamah akan menetapkan tarikh awal untuk mendengar rayuan Zambry.
Zambry berkata dengan keputusan mahkamah itu, kedudukan Setiausaha Kerajaan Negeri Perak Datuk Seri Datuk Dr Abdul Rahman Hashim dan Penasihat Undang-Undang Negeri Datuk Ahmad Kamal Shahid adalah kekal.
Lagi pun keputusan menggantung mereka yang dibuat oleh mesyuarat Exco yang dipengerusikan Mohammad Nizar lewat malam tadi hingga awal pagi ini hanya terlaksana jika ada mesyuarat Exco sekali lagi bagi mengesahkannnya.
Mohammad Nizar hari ini telah menggantung tugas Dr Abdul Rahman dan melantik Pegawai Kewangan Negeri Datuk Jamaluddin Al Amini Ahmad memangku jawatan itu.
Mohammad Nizar juga mengumumkan penggantungan tugas Ahmad Kamal. Notis penggantungan tugas Dr Abdul Rahman dan Ahmad Kamal telah ditampal di papan kenyataan Bangunan Perak Darul Ridzuan.
Sementara itu, Mohammad Nizar dan para anggota Exconya akur dengan keputusan Mahkamah Rayuan itu dan telah mengosongkan pejabat mereka mulai pukul 2.30 petang.
Bercakap pada sidang akhbar di pejabat DAP Perak, beliau berkata pihak peguamnya sedang mengkaji kemungkinan memohon rayuan bagi mengenepikan keputusan Mahkamah Rayuan itu.
Pakatan DAP-PKR-PAS akur dengan perintah itu walaupun menyifatkan keputusan berkenaan sebagai 'luar biasa' dan menimbulkan banyak lagi persoalan yang akan merumitkan lagi keadaan, katanya.
"Kami akan mendapatkan nasihat daripada panel peguam kami untuk tindakan selanjutnya. Kami akan mengikut peraturan undang-undang yang dibenarkan," katanya.
Mohammad Nizar juga mengulangi pendirian pakatan pembangkang itu tetap mahu membubarkan Dewan Undangan Negeri (DUN) bagi memulihkan keadaan politik di Perak.
Ketika ditanya kesediaan pakatan itu jika usul undi tidak percaya terhadap beliau sebagai menteri besar dibawa ke dalam persidangan DUN, beliau berkata: "Kita akan tengok jika ia dilakukan dengan syarat-syarat yang dibenarkan.
"Setiap ketika jawatan menteri besar itu, iaitu dari saya mengangkat sumpah ia tidak pernah dikosongkan dan saya tidak pernah letak jawatan."
Ditanya pertemuan beliau dengan Pemangku Raja Perak Raja Dr Nazrin Shah di Istana Iskandariah di Kuala Kangsar hari ini, Mohammad Nizar berkata beliau berbual panjang dengan baginda secara am dan bukan mengenai isu politik.
Sebelum itu, Mohammad Nizar dikatakan telah mengutus surat memohon menghadap Sultan Perak bagi meminta perkenan baginda membubarkan DUN Perak.
Ekoran perkembangan berkenaan, polis terus mengadakan kawalan di pintu masuk ke bangunan Perak Darul Ridzuan.

Semalam tepat jam 3.30 petang pimpinan PKR yang diketuai oleh Timbalannya Haji Ahmad Zainal telah membuat laporan polis mengenai perkara tersebut di Balai Polis di sini.
Menurut Ketua KeADILan di sini Haji Mohd Aun Mansor partinya juga akan membuat aduan polis mengenai pemecatan tugas Ketua Kampung dan AJKKK Kerajaan Pakatan Rakyat oleh Umno/BN baru-baru ini.

ACID TEST FOR RAJA NAZRIN TO ACT OR NOT TO ACT NOW

The Raja Muda of Perak, Raja Nazrin Shah, is empowered by the Perak constitution to decide on a request by the menteri besar to dissolve the state assembly.
Constitutional lawyer Tommy Thomas said that Article 15 under Part II of the state constitution stipulated that the regent could be the acting sovereign in the event that the sultan was away for more than 30 days.
"We can safely assume that Sultan Azlan Shah is away, and that Raja Nazrin Shah is acting sovereign when he (Raja Nazrin) opened the state assembly last Thursday (7 May)," Thomas said in a phone interview today.
Thomas served as legal counsel for embattled Speaker V Sivakumar in the suit brought against him by assemblypersons Jamaluddin Mohd Radzi (Behrang), Capt (R) Mohd Osman Jailu (Changkat Jering) and Hee Yit Foong (Jelapang).
Thomas added that under Article 17 of the constitution, the regent, when acting as the sovereign, is empowered to exercise all the prerogatives and perform all the duties of the sovereign.
"This means that Raja Nazrin Shah can make the decision about dissolving the state assembly as provided under Article 36(2) of the Perak state constitution," he said.
Earlier today, the High Court ruled that Pakatan Rakyat's Datuk Seri Mohammad Nizar Jamaluddin was the rightful menteri besar of Perak, providing some relief to more than three months of uncertainty as to who should head the state government.
A jubilant Nizar, who was in court today, told reporters he would immediately return to Ipoh to seek an audience with Perak ruler Sultan Azlan Shah for a dissolution of the state assembly.
However, it is believed that the sultan is currently overseas, and Nizar will probably seek an audience with Raja Nazrin tomorrow morning in Kuala Kangsar.
Raja Nazrin Shah Nizar was ousted after the Barisan Nasional (BN)'s Datuk Seri Dr Zambry Abdul Kadir was sworn in as Perak menteri besar on 6 Feb following the BN takeover of the state government. The takeover was precipitated by the defection of three Pakatan Rakyat (PR) assemblypersons who opted to become BN-friendly independents, leading to the PR losing its majority in the state assembly.
Nizar had sought an audience with the sultan of Perak on 5 May to request the dissolution of the state assembly but was turned down and instead ordered to step down as MB.
On 13 Feb, Nizar, 52, filed an application to the court for a declaration that he was at all material times the menteri besar of Perak. He also sought a declaration that Zambry had no right to hold the office of menteri besar.
Prime Minister Datuk Seri Najib Razak has said that the BN will appeal against the High Court's decision.

In yet another twist to the Perak political crisis, the High Court today declared Datuk Seri Mohammad Nizar Jamaluddin the rightful Mentri Besar of Perak.
The decision comes just four days after the tumultous one-day Perak Assembly sitting on Thursday which saw the Pakatan Rakyat Speaker V. Sivakumar being forcibly removed from the House, to be replaced by Datuk R. Ganesan, as the Barisan Nasional took control of the assembly.
Barisan Nasional, led by Datuk Dr Zambry Abd Kadir, toppled the 10-month-old Pakatan government in Perak in February after three PR assemblymen left their parties to become BN-friendly independents.
On Feb 13, Nizar, 52, filed an application to the court for a declaration that he is at all material times the rightful Mentri Besar of Perak.
In allowing five prayers sought by Nizar in his application for judicial review yesterday, Judge Datuk Abdul Aziz Abdul Rahim said once the Mentri Besar is appointed, he is only answerable to the State Legislative Assembly, and could only be removed by a vote of no confidence.
"Any measure of loss of confidence should be taken on the floor of the State Legislative Assembly by vote of no confidence. Only in this way can a Mentri Besar resign," he said.
He said Nizar never had a vote of no confidence taken against him in the Assembly and he did not request for a dissolution because of loss of confidence by the majority.
"Why did the Barisan Nasional not request Nizar to be summoned to the State Legislative Assembly to have a special sitting for a motion of no confidence to be passed? This would be in accordance with the democratic process," said Abdul Aziz.
Abdul Aziz said a Mentri Besar could not be dismissed by the Sultan of Perak for the reason that he did not hold the office at the sultan's pleasure.
The dismissal of the Mentri Besar by the Sultan was never contemplated by Article 16(6) of the Perak Constitution, he added.
As such, he said he was of the view that the office of the Menteri Besar of Perak had not become vacant or was vacated.
The five prayers sought for declarations were;
> that Nizar is the rightful Mentri Besar
> there was no dissolution of the Perak Assembly, no motion of no-confidence was passed against him in the Assembly and that he did not resign
> a writ of quo warranto is issued against Zambry ordering him to show cause and this information is made under what policy /power/ and authority he allegedly holds office as Mentri Besar, and allegedly acts or exercises or implements responsibility/ functions/ duties of Perak Mentri Besar
> a declaration order that Zambry has no right to act/occupy the office of Mentri Besar and he was not Perak Mentri Besar at any material time
> an injunction order to prevent Zambry and his agents or servants from acting and exercising and implementing the responsibility and functions or duties of Mentri Besar.
(Nizar had asked for punitive, aggravated and exemplery damages, an inquiry into the damages and costs but withdrew them last week)
After the decision, Zambry's lawyer Datuk Cecil Abraham asked for an application for a stay.
However, Abdul Aziz said he was reluctant to grant it as he had to consider legal points for a stay application on declaratory orders.
Nizar's lawyer, Sulaiman Abdullah, said he had been given instruction that Nizar intended to go back to Perak to seek a dissolution of the assembly and that would solve the problem immediately.
Attorney-General Tan Sri Abdul Gani Patail also asked the judge to decide immediately as it would be easier for the parties.
However, the judge said he was refusing an oral application for a stay and asked Cecil to put in a formal application (written) along with the authorities (cases).
"I am refusing the oral judgement," said Abdul Aziz.

» He disagreed with the submission of Attorney-General Tan Sri Abdul Gani Patail, as intervenor, that there were only two circumstances under which a mentri besar could request for the dissolution of the legislative assembly.
"The A-G submitted that a mentri besar can only request for dissolution when the life term of the assembly comes to an end, that is under Article 36(2) and the other one is when he ceases to have command of the majority.
"I do not agree with this. Under Article 36 of the Perak Constitution, there are unlimited circumstances for the menteri besar to request for dissolution from the Sultan, and it is up to the mentri besar to choose his time (to request for dissolution)."
» He also disagreed with the A-G and Dr Zambry Abd Kadir's earlier submission that Nizar was deemed to have resigned from the office of mentri besar although he (Nizar) refused to do so.
"The A-G and the respondent argued that the word 'shall resign' in Article 16(6) meant that it is mandatory that the menteri besar must resign.
"What if the mentri besar refuses to resign? However mandatory it is, the provision cannot be interpreted to mean that the mentri besar is deemed to resign," said Abdul Aziz, who suggested that the article be amended to rectify the lacuna in Article 16(6) of the Perak Constitution.
» On the issue of the affidavit by Perak State Legal Adviser Datuk Ahmad Kamal Md Shahid, Abdul Aziz ruled that he was not a neutral and impartial witness.
"It was his own admission that he was instructed by the respondent's counsel to affirm the affidavit. The word instructed is a very strong word.
"To me, he is not a neutral or impartial witness; his testimony was coloured by the instruction that he received," said Abdul Aziz.
» He preferred Nizar's version of what transpired during the audience with the Sultan of Perak at Istana Kinta on Feb 4, that he asked for a dissolution under Article 36 (2) for general purpose than Ahmad Kamal's evidence that the request was made under Article 16(6) due to loss of confidence.
He said Kamal had testified he had no personal interest and nothing to benefit from the case but he would take Kamal's evidence with a "pinch of salt".
He said Kamal testified under cross-examination that he did not make any effort to contact Nizar to correct the Proclamation of Dissolution that Nizar took with him when asking for dissolution from the Sultan of Perak.
(In the Proclamation of Dissolution draft, Nizar asked for dissolution under Article 36(2) for dissolution under general provision. Kamal said Nizar was asking for a dissolution under Article 16 (6) stating loss of confidence).
Abdul Aziz said Kamal read the Proclamation and he should have "realised the mistake" but made no correction.
"I would have thought he would contact Nizar to correct or suggest correction before presenting to the Sultan."
Abdul Aziz said Kamal testified he did not take the course of action, saying that the Sultan had not decided yet.
He said Kamal is state legal adviser and his duty is to advise on all legal matters referred to him, including advising Nizar on the draft of Proclamation.

Presiden Umno itu berkata, ini kerana masih ada ruang untuk parti memikirkan langkah-langkah yang wajar dilakukan dalam menghadapi kemelut itu.
"Ini bukan penghujung jalan, masih ada jalan untuk difikirkan langkah-langkah. Saya dan rakan-rakan dalam Majlis Tertinggi (MT) akan fikir dengan semasak-masaknya apa yang terbaik untuk Umno dan BN yang kita kasihi," katanya ketika berucap pada majlis Ulang tahun ke-63 Umno di Pusat Dagangan Dunia Putra, di sini, Isnin malam.
Beliau berkata, keputusan mahkamah itu bukanlah kegagalan pertama kerana sebagai sebuah parti, Umno telah melalui banyak cabaran dan dugaan sepanjang perjalanannya, termasuk menerima beberapa keputusan mahkamah yang tidak memihak kepada parti.
"Dalam sejarah Umno kita pernah terima keputusan mahkamah yang mengharamkan Umno, tetapi kita bangkit dengan Umno Baru dan saya percaya semangat yang sama mesti ada pada kita (dalam menghadapi isu kemelut politik di Perak)," katanya.

SEMAKIN banyak pihak menimbangkan kesahihan perlucutan V Sivakumar daripada jawatan Speaker Dewan Undangan Negeri Perak dan pengundian pengganti beliau, R Ganesan, bekas Adun Sungkai, dan juga dua lagi usul.
Peguam dan juga Presiden Persatuan Kebangsaan Hak Asasi Manusia (Hakam) Malik Imtaz Sarwar tidak bersetuju dengan pandangan Dato' Hafarizam Harun dan Dato' Muhammad Shafee Abdullah, yang dilaporkan berkata bahawa usul yang diluluskan 7 Mei adalah sah.
"Saya tidak bersetuju dengan pandangan Hafarizam dan Shafee. Saya tak nampak bagaimana it boleh menjadi sah," jelas Malik Imtaz kepada Malaysian Insider.

Dia mendapati terlalu banyak persoalan berhubung prosidur di dalam ruang dewan, mengakibatkan kesahihannya diragui.
"Pertama, bagaimanakah persidangan itu boleh sampai ke peringkat di mana Hee mengambil alih persidangan?" beliau mempersoalkan, merujuk kepada Hee Yit Foong, Adun Jelapang merangkap Timbalan Speaker.
"Sekiranya Sivakumar berada di situ secara sah, bagaimana dia (Hee) boleh mengambil alih (tugas Speaker)?" tambah beliau, merujuk kepada penjelasan Hafarizam yang membuat rujukan kepada Perkara 36A(1)(b) Peraturan Persidangan yang membenarkan Timbalan Speaker mengambil tempat menggantikan Speaker.
Versi bercanggah
Kata Imtaz, dia mendengar versi yang bercanggah-canggah mengenai peristiwa 7 Mei, termasuk dakwaan kononnya pada satu ketika Sivakumar tidak berada di dalam kamar dewan sewaktu persidangan berlangsung.
Beliau juga mempersoalkan kehadiran pegawai polis berpakaian biasa di dalam kamar dewan.
"Polis tidak sama sekali mempunyai kuasa dalam kamar dewan," kata Imtaz, dan merujuk kepada kenyataan terdahulu oleh Menteri Dalam Negeri ketika itu Syed Hamid Albar dan Ketua Polis Negara pada Mac lalu selepas Ahli Parlimen Pakatan Rakyat Karpal Singh dikasari di Parlimen.
Syed Hamid dan Musa Hassan menegaskan bahawa pihak polis tidak boleh campur tangan dalam kamar dewan walaupun sekiranya terdapat pergaduhan dan hanya petugas dewan (sergeant-at-arms) mempunyai kuasa menangkap.
Polis bukan agen parti politik
"Polis telah bertindak tanpa kuasa. Mereka sebenarnya menjadikan diri mereka sebagai agen kepada sebuah parti politik dan bukan sebagai pelaksana bebas undang-undang," kata Imtaz, sambil menekankan bahawa Sivakumar adalah masih Speaker yang sah ketika itu.
Sementara menekankan pandangannya bahawa tidak bermakna Adun Pakatan Rakyat bebas daripada apa-apa perlakuan salah, Imtaz menolak penjelasan Dr Zambry Abdul Kadir yang mengatakan BN tidak mempunyai pilihan kecuali memanggil polis apabila keadaan menjadi semakin tegang.
"Mereka mengatakan mereka tidak ada pilihan tapi itu tidak benar. Mereka boleh sahaja memfail untuk mendapatkan perintah mahkamah dan menyebut Sivakumar sebagai menghina mahkamah. Mereka tidak melakukan demikian tetapi memilih untuk membantu diri-sendiri tetapi membantu diri-sendiri tidak dibenarkan di bawah sistem perundangan kita," jelas Imtaz lagi dengan nada marah.
"Bahkan, cara paksaan terpaksa digunakan - dengan menggunakan polis untuk memaksa Sivakumar keluar dari kamar dewan tanpa sebarang alasan-� ini adalah merupakan penunjuk yang mencukupi bahawa BN tidak mempunyai penyelesaian politik mahupun perundangan terhadap kesulitan yang mereka sendiri mulakan."
Beliau juga mempersoalkan: "Pada saat manakan persidangan sebenarnya bermula?"
Bila sidang bermula?
"Sekiranya perasmian persidangan bermula selepas titah Raja Nazrin, bagaimanapula mereka menjalankan sebarang urusan sebelum itu?" tanya Imtaz.
Beliau menekankan, Raja Muda Perak yang sepatutnya membuka persidangan, memasuki kamar dewan hanya pada kira-kira jam 3.00 petang, setelah berlaku perebutan kerusi Speaker dan setelah tiga lagi usul - pemilihan Ganesan sebagai Speaker, anggota baru untuk jawatankuasa sampingan dan kelulusan pengisytiharan pembatalan sidang Pakatan Rakyat terdahulu yang diadakan di bawah sebatang pohon.
Imtaz juga menegaskan persidangan tersebut juga melanggar beberapa lagi konvensyen, termasuk tidak mengadakan upacara mengangkat sumpah untuk Ganesan selaku Speaker. Ini, tegasnya, biasanya diadakan dalam satu upacara di masa lain di hadapan raja.
Terus buntu
"Inilah antara perkara yang menyebabkan saya merasa ragu tentang kesahan usul yang diluluskan," kata peguam yang baru-baru ini menjadi penerima anugerah hak asasi manusia antarabangsa.
"Akhirnya, terdapat kebuntuan di sini," katanya, dan menambah sekiranya Perdana Menteri Najib Razak "ikhlas tentang Satu Malaysia, dia tidak boleh membenarkan BN melakukan tindakan tersebut."
Bagi pensyarah undang-undang Perlembagaan Universiti Islam Antarabangsa, Profesor Abdul Aziz Bari, "semuanya begitu jelas dan terpampang."
Katanya, dia bersetuju dengan Ir Mohammad Nizar Jamaluddin bahawa persidangan 7 Mei adalah "haram dan tidak berperlembagaan".
Cara salah pilih Speaker
"Bagi saya, cara mereka memilih Speaker adalah salah. Speaker masih Sivakumar," jelas ahli akademik itu.
Beliau memerhatikan bahawa urutan peristiwa dari 5 Februari sehingga semalam - dari perbuatan melompat parti yang dilakukan wakil rakyat yang dipilih sehinggalah kepada keputusan mahkamah membatalkan keputusan Sivakumar untuk menggantung kehadiran Adun BN - membuatkan kesahihan usul cukup meragukan menurut pandangannya.
Seperti juga Malik Imtiaz, Presiden Majlis Peguam Malaysia Ragunath Kesavan bersetuju situasi di Perak sudah tiba pada titik di mana tidak ada jalan lain kecuali Sultan Perakmembubarkan dewan undangan dan membuka jalan untuk pilihan raya umum baru bagi membersihkan kemelut yang berlaku.
Undang-undang tak boleh selesai masalah
"Bagi kita, cara perundangan tidak akan dapat menyelesaikannya kerana setiap peguam mempunyai pendapat berbeza," katanya.
"Secara peribadi, saya rasa terdapat hujah yang memihak kepada kedua-dua pihak. Satu daripadanya bilakah persidangan itu sebenarnya bermula? Satu lagi apakah Speaker mempunyai kuasa untuk menolak usul yang hendak dibentangkan?"
"Tapi kini Pakatan Rakyat adalah pihak minoriti dan BN mempunyai majoriti stabil dengan 28 campur tiga bebas," jelasnya.
Ragunath menekankan cara terbaik untuk keluar dari permasalahan tersebut ialah membenarkan pengundi membuat keputusan.
"Saya tak fakir dalam demokrasi, untuk kembali semula kepada rakyat setelah baru sahaja mengadakan pilihan raya umum merupakan satu masalah," katanya.
